TO DIRECT THE STATE BUDGET AND CONTROL BOARD TO CONDUCT A STUDY TO DETERMINE THE ACTUAL OPERATING COSTS OF THE DEPARTMENT OF JUVENILE JUSTICE INCURRED DUE TO THE HOUSING OF JUVENILES AWAITING ADJUDICATION OF CRIMINAL CHARGES; TO DIRECT THE BOARD, AT THE COMPLETION OF THE STUDY, TO DERIVE A FIGURE ENTITLED "THE PER DIEM FOR JUVENILE PRE-ADJUDICATION DETENTION"; AND TO PROVIDE THAT THE DEPARTMENT OF JUVENILE JUSTICE SHALL ASSESS A COUNTY AN AMOUNT EQUAL TO ONE HALF OF "THE PER DIEM FOR JUVENILE PRE-ADJUDICATION DETENTION" FOR EACH JUVENILE THAT THE DEPARTMENT HOUSES ON BEHALF OF THE COUNTY FOR EACH DAY THAT THE CHILD IS HOUSED WITH THE DEPARTMENT.
Be it enacted by the General Assembly of the State of South Carolina:
SECTION 1. The State Budget and Control Board is directed to conduct a study to determine the actual operating costs of the Department of Juvenile Justice incurred due to the housing of juveniles awaiting adjudication of criminal charges. At the completion of the study, the board shall derive a figure entitled "The per diem for juvenile pre-adjudication detention." This figure shall exclude capital facility costs. The Department of Juvenile Justice shall assess a county an amount equal to one-half of "The per diem for juvenile pre-adjudication detention" for each juvenile that the department houses on behalf of the county for each day that the child is housed with the department. The remaining cost of the detention shall be borne by the department. The department may retain and expend any payment received from a county for housing a child for purposes of operating these facilities. The board shall derive "The per diem for juvenile pre-adjudication detention" each fiscal year.
SECTION 2. Section 20-7-3230 is superseded to the extent that it conflicts with this section.
SECTION 3. This joint resolution takes effect upon approval by the Governor.
