TO AMEND SECTION 56-5-1860, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO LIMITATIONS ON OVERTAKING ANOTHER VEHICLE ON THE LEFT, SO AS TO PROVIDE THAT A VEHICLE ATTEMPTING TO OVERTAKE OR PASS ANOTHER VEHICLE MUST YIELD THE RIGHT-OF-WAY TO A VEHICLE ATTEMPTING TO MOVE TO THE LEFT THAT HAS GIVEN THE APPROPRIATE SIGNALS AS CONTAINED IN SECTION 56-5-2150.
Be it enacted by the General Assembly of the State of South Carolina:
SECTION 1. Section 56-5-1860 of the 1976 Code is amended to read:
"Section 56-5-1860. No A vehicle shall must not be driven to the left side of the center of the roadway in overtaking and passing another vehicle proceeding in the same direction unless the left side is clearly visible and is free of oncoming traffic for a sufficient distance ahead to permit such the overtaking and passing to be completely made without interfering with the operation of any a vehicle approaching from the opposite direction or any a vehicle overtaken. In every event the The overtaking vehicle must return to an authorized lane of travel as soon as practicable and in the event the passing movement involves the use of a lane authorized for vehicles approaching from the opposite direction, before coming within two hundred feet of any an approaching vehicle.
A vehicle attempting to overtake or pass another vehicle on the left side of center of the roadway shall yield the right-of-way to a vehicle attempting to move left upon a roadway pursuant to Section 56-5-2150."
SECTION 2. This act takes effect upon approval by the Governor.
