TO CREATE A TASK FORCE TO STUDY THE MERIT AND FEASIBILITY OF TRANSFERRING TO THE DEPARTMENT OF HEALTH AND ENVIRONMENTAL CONTROL THE LICENSING AND REGULATORY AUTHORITY FOR CHILD DAY CARE FROM THE DEPARTMENT OF SOCIAL SERVICES AND THE INSPECTION RESPONSIBILITY OF THE STATE FIRE MARSHAL AND TO REQUIRE THE TASK FORCE TO REPORT TO THE GOVERNOR AND GENERAL ASSEMBLY BEFORE JANUARY 1, 2000, AT WHICH TIME THE TASK FORCE IS ABOLISHED.
Be it enacted by the General Assembly of the State of South Carolina:
SECTION 1. (A) There is created a task force to evaluate the current management, oversight, and regulation of the child day care industry to assess the merit and feasibility of transferring to the Department of Health and Environmental Control the licensing and regulatory authority for child day care of the Department of Social Services and the inspection responsibility of the State Fire Marshal.
(B) This task force is comprised of:
(1) the director of the Office of Health and Human Services, Office of the Governor, or his designee;
(2) the director of the Department of Social Services or his designee;
(3) the director of the Department of Health and Environmental Control or his designee;
(4) the chairman of the State Advisory Committee on the Regulation of Child Day Care Facilities;
(5) two individuals from each of the following, one of whom must be appointed by the Speaker of the House of Representatives and one by the President of the Senate:
(a) an owner or operator of a child day care center;
(b) an owner or operator of a group day care home;
(c) an operator of a family day care home;
(d) an operator of a church or religious day care center.
(C) Members of the task force shall receive mileage and per diem as authorized by law for members of state boards, committees, or commissions. The directors of research for the House Medical, Military, Public and Municipal Affairs Committee and the Senate Medical Affairs Committee shall provide staff assistance to the task force.
(D) The task force shall submit its report and recommendations to the Governor and General Assembly before January 1, 2000, at which time the task force is abolished.
SECTION 2. This joint resolution takes effect upon approval by the Governor.
