TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 29-1-60 SO AS TO PROVIDE THAT IF AN OWNER OF PROPERTY PRESENTS CERTIFIED DOCUMENTATION FROM THE LIENHOLDER TO THE CLERK OF COURT, THE CLERK OF COURT SHALL ISSUE AN ADMINISTRATIVE ORDER REMOVING THE LIEN AND REVISE RECORDS NECESSARY TO CORRECT THE ERROR.
Be it enacted by the General Assembly of the State of South Carolina:
SECTION 1. The 1976 Code is amended by adding:
"Section 29-1-60. Notwithstanding any other provision of law, if a lien is placed on property in error and the owner of the property presents certified documentation to the clerk of court from the lienholder that the lien is in error, the clerk of court shall issue an administrative order removing the lien and revise any necessary records. It is not necessary to conduct a hearing before a judge to remove the lien."
SECTION 2. This act takes effect upon approval by the Governor.
