TO AMEND CHAPTER 23, TITLE 12, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO LICENSES ON CERTAIN BUSINESSES, BY ADDING ARTICLE 13 SO AS TO REQUIRE AMBULANCE PROVIDERS TO PAY AN ANNUAL FRANCHISE FEE BASED ON THE NUMBER OF PATIENTS TRANSPORTED.
Be it enacted by the General Assembly of the State of South Carolina:
SECTION 1. Chapter 23, Title 12 of the 1976 Code is amended by adding:
Section 12-23-1110. Each ambulance provider shall pay an ambulance franchise fee which must be remitted to the department in accordance with procedures established by the department. The fee must be calculated based upon the number of patients transported, multiplied by two dollars.
Section 12-23-1120. (A) The Department of Revenue shall issue assessments for the fee provided by this article based on information provided by the Department of Health and Human Services.
(B) Revenues derived under the provisions of this article must be credited to the Department of Health and Human Services' Medicaid programs.
Section 12-23-1130. The Department of Revenue shall administer and enforce the provisions of this article and may promulgate regulations to enforce these provisions. The franchise fee levied pursuant to this article must be collected in accordance with the provisions of Chapter 54 of Title 12."
SECTION 2. This act takes effect upon approval by the Governor.
