TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 59-17-105 SO AS TO PROVIDE THAT WHEN THE SUPERINTENDENT OF EDUCATION HAS RELEVANT INFORMATION THAT IMPROPRIETIES MAY EXIST, INCLUDING BUT NOT LIMITED TO VIOLATIONS OF LAW, IN REGARD TO THE FISCAL AFFAIRS OF A SCHOOL DISTRICT OF THIS STATE, THE SUPERINTENDENT MAY REQUIRE AN AUDIT OF THE DISTRICT'S FINANCIAL AFFAIRS BY THE DEPARTMENT OF EDUCATION, AND TO PROVIDE FOR THE MANNER IN WHICH THE AUDIT SHALL BE CONDUCTED.
Be it enacted by the General Assembly of the State of South Carolina:
SECTION 1. The 1976 Code is amended by adding:
"Section 59-17-105. When the Superintendent of Education has relevant information that improprieties may exist, including but not limited to violations of law, in regard to the fiscal affairs of a school district of this State, the Superintendent may require an audit of the district's financial affairs by the Department of Education. The Superintendent shall inform the board of trustees of the district before the audit of the relevant information in the possession of the Superintendent justifying the audit. The department for this purpose may use its own personnel or may engage outside auditors who shall report its results directly to the Superintendent. The board of trustees of the district also shall be informed by the Superintendent of the audit's results but otherwise may not object to the conduct of the audit. All district employees are required to cooperate with the department in regard to the audit."
SECTION 2. This act takes effect upon approval by the Governor.
