A BILL

TO AMEND SECTION 54-3-20, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO THE APPOINTMENT OF MEMBERS OF THE BOARD OF THE SOUTH CAROLINA STATE PORTS AUTHORITY, SO AS TO PROVIDE THAT MEMBERS SHALL BE APPOINTED FROM THE CONGRESSIONAL DISTRICTS AND THE STATE AT LARGE AND MUST BE APPOINTED TO STAGGERED TERMS NO LATER THAN MARCH 1, 2005.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION    1.    Section 54-3-20 of the 1976 Code is amended to read:

"Section 54-3-20.    The members of the board shall be appointed by the Governor, with the advice and consent of the Senate, for terms of seven years each and until their successors shall have been appointed and have qualified as follows: one from each congressional district of the State and three from the State at large. Members representing the first, second, and third congressional districts must be appointed in 2005, by the first of March, and shall each serve initial terms beginning March 1, 2005 and ending February 28, 2006. Thereafter, members representing the first, second, and third congressional districts shall each serve four-year terms and until their successors are appointed and qualify. Members representing the fourth, fifth, and sixth congressional districts must be appointed in 2005, by the first of March, and shall each serve initial terms beginning March 1, 2005 and ending February 28, 2007. Thereafter, members representing the fourth, fifth, and sixth congressional districts shall each serve four-year terms and until their successors are appointed and qualify. Members representing the State at large must be appointed in 2005, by the first of March, and shall each serve initial terms beginning March 1, 2005 and ending February 29, 2008. Thereafter, members representing the State at large shall each serve four-year terms and until their successors are appointed and qualify. In the event of a vacancy, however caused, a successor shall be appointed in the manner of original appointment for the unexpired term.

The terms of members serving in office on the date this act is approved by the Governor shall cease on February 28, 2005; however, nothing in this section prohibits the Governor from reappointing any of those members to the board consistent with the provisions of this section."

SECTION    2.    This act takes effect upon approval by the Governor.
