A JOINT RESOLUTION

TO ESTABLISH A JOINT BUDGET TASK FORCE TO CONDUCT A THOROUGH REVIEW OF THE STATE'S SPENDING PRIORITIES AS DETERMINED AND FUNDED THROUGH THE ANNUAL STATE BUDGET AND APPROPRIATIONS PROCESS, TO PROVIDE FOR THE TASK FORCE TO CONCLUDE ITS SIX-MONTH REVIEW WITH THE PRESENTATION OF A REPORT AND RECOMMENDATIONS TO THE GENERAL ASSEMBLY AND THE GOVERNOR NO LATER THAN DECEMBER 31, 2003, CONTAINING A COMPREHENSIVE REDETERMINATION OF APPROPRIATE SPENDING PRIORITIES AND A TEMPLATE ESTABLISHING CRITERIA FOR USE BY THE GOVERNOR AND THE GENERAL ASSEMBLY, INCLUDING ITS COMMITTEES, IN A "ZERO-BASE" BUDGET PROCESS IN THE PREPARATION OF THE STATE GENERAL APPROPRIATIONS ACT, AND TO PROVIDE FOR THE MEMBERSHIP OF THE TASK FORCE, ITS DUTIES, EXPENSES, AND STAFFING.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION    1.    (A)    To establish the Joint Budget Task Force to conduct a thorough review of the annual state budget and appropriations process, specifically as to the State of South Carolina's spending priorities as determined and funded through that process. The joint task force must be composed of the following members:

(1)    chairmen of the Senate Finance Committee and the Ways and Means Committee of the House of Representatives;

(2)    chairmen of all subcommittees of the Senate Finance Committee and the House Ways and Means Committee; and

(3)    seven additional members, one each appointed by the Governor, the Speaker of the House of Representatives, the President Pro Tempore of the Senate, the minority leader of the House of Representatives; the minority leader of the Senate, the majority leader of the House of Representatives, and the majority leader of the Senate.

(B)    The task force shall:

(1)    conduct a detailed, careful, and comprehensive review of the spending priorities of the State as determined and funded by the annual budget and appropriations process of the State, together with all rules, regulations, practices, and laws of the State which have an impact on the establishment of the priority and amounts of the state's expenditures, and to make recommendations to the General Assembly and the Governor, including a comprehensive redetermination of appropriate spending priorities; and

(2)    recommend changes in the budget and appropriations structure of the State necessary to the institution of a "zero-base" state budget and appropriations process, including a template establishing criteria for use by the Governor and the General Assembly, and its committees, in a "zero-base" budget process in the preparation of the state general appropriations act.

(C)    In achieving its objectives, the task force may:

(1)    hold public hearings;

(2)    receive testimony of employees of the State or other witnesses who may assist the committee in its duties;

(3)    call for assistance in the performance of its duties from employees or agencies of the State or of its political subdivisions; and

(4)    adopt by majority vote rules not inconsistent with this resolution it considers proper with respect to matters relating to the discharge of its duties pursuant to this resolution.

SECTION    2.    The professional and clerical services for the committee must be made available from the staffs of the General Assembly, the Budget and Control Board, the Department of Revenue, and other state agencies and institutions.

SECTION    3.    The task force shall commence operation on July 1, 2003, and make its reports and recommendations to the General Assembly and the Governor by December 31, 2003, at which time the task force must be dissolved and its existence terminated. These findings and recommendations must be published and made available to the public.

SECTION    4.    The members of the task force serve ex officio and may not receive the per diem, mileage, and subsistence as is allowed by law for members of boards, committees, and commissions when engaged in the exercise of their duties as members of the committee.

SECTION    5.    This joint resolution takes effect upon approval by the Governor.
