A BILL

TO AMEND ACT 612 OF 1984, RELATING TO THE SPARTANBURG COUNTY SCHOOL BOARD ELECTIONS, INCLUDING REQUIRING THAT A PETITION BE FILED IN ORDER TO PLACE A CANDIDATE ON THE BALLOT, SO AS TO PROVIDE THAT AN INCUMBENT BOARD MEMBER WHO HAS PREVIOUSLY MET THIS PETITION REQUIREMENT AND WHO HAS BEEN IN CONTINUOUS SERVICE IS ONLY REQUIRED TO SUBMIT HIS OR HER NAME AND A ONE HUNDRED DOLLAR FILING FEE AND TO DELETE THE PROVISION THAT IF NO PETITION IS FILED THE BOARD OF EDUCATION MUST APPOINT A SUCCESSOR.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION    1.    Section 1(C) of Act 612 of 1984 is amended to read:

"(C)    To place the name of a candidate on the ballot, qualified electors of the school district must file with the Spartanburg County Election Commission, not less than sixty days before the date of the election, a petition which must contain the names of qualified electors of a number equal to not less than three hundred, fifty qualified electors of the district which the candidate seeks to represent or five percent of the total number of electors of the district which the candidate seeks to represent, whichever is the lesser. In the event no petition is filed within the time limits specified, the county board of education must appoint a successor However, an incumbent member of the board of trustees who has met this petition requirement at least once previously and who has been in continuous service as a member of the board of trustees since the filing of the petition is not required to file another petition containing names of qualified electors but may submit his or her name and a candidate filing fee of one hundred dollars to the Spartanburg County Election Commission not less than sixty days before the date of the election."

SECTION    2.    This act takes effect upon approval by the Governor.
