To whom was referred a Bill (H. 4089) to amend Section 42-1-360, Code of Laws of South Carolina, 1976, relating to exemptions of employees from the workers' compensation law, so as to include, etc., respectfully

REPORT:

That they have duly and carefully considered the same and recommend that the same do pass:

A BILL

TO AMEND SECTION 42-1-360, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO EXEMPTIONS OF EMPLOYEES FROM THE WORKERS' COMPENSATION LAW, SO AS TO INCLUDE CERTAIN EMPLOYEES OF A RESIDENTIAL CONSTRUCTION COMPANY AS BEING EXEMPT.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION    1.    Section 42-1-360(2) of the 1976 Code is amended to read:

"(2)    Any a person who has regularly has employed in service less than four employees in the same business within the State or who had a total annual payroll during the previous calendar year of less than three thousand dollars regardless of the number of persons employed during that period. Notwithstanding another provision of law, sole proprietors, partners, officers of corporations, and their employees, regardless of the number or amount of their annual payroll, or both, that practice or offer to practice residential building as defined by Section 40-59-20(6), residential specialty contracting as defined by Section 40-59-20(7), or related home building services, are not eligible for the exemptions from the requirement to carry workers' compensation insurance, unless their job responsibility does not require them specifically to visit or perform work on a residential building site;"

SECTION    2.    This act takes effect upon approval by the Governor.
