A BILL

TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 44-96-321 SO AS TO PROHIBIT THE SITING OF A CONSTRUCTION AND DEMOLITION LANDFILL WITHIN THREE MILES OF AN ALREADY EXISTING CONSTRUCTION AND DEMOLITION LANDFILL.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION    1.    Article 2, Chapter 96, Title 44, of the 1976 Code is amended by adding:

"Section 44-96-321.    Notwithstanding any other provision of law, no construction and demolition landfill may be sited within three miles of an already existing construction and demolition landfill."

SECTION    2.    This act takes effect upon approval by the Governor.
