Today, O Lord, the Senate of South Carolina has come back to this State House in order to tackle unfinished tasks. It is truly safe to say that every woman and man in our State is hopeful that this body will indeed knuckle down and do all it can to provide comfort -- not as You, O Lord, offer us comfort, of course -- but "comfort" for our people in the form of clear and meaningful action leading to positive results. That is all we seek, O God. So we pray this day that You will guide, energize, and empower each of these servants so that they can do just that. In Your hopeful and blessed name we pray, dear Lord. Amen.

Thank you, Mr. PRESIDENT and members of the Senate. The great Senate experiment of 2015 is a great disappointment. I rise not to fix the blame, but I rise to fix the problem. Members of the Senate, words matter and actions matter. Words matter and actions or lack thereof matter. Words like dysfunctional Senate. Dysfunctional Senate -- those two words have been echoed through this Senate for the last two weeks. I've heard it all over this State; we have a dysfunctional Senate. Lack of actions matter -- no Ethics Act, no Department of Transportation reform, no income tax reduction, no Roads Bill, on the eve of no budget and flirting with shutting the Government down.
I'm the Majority Leader, Senator SETZLER is the Minority Leader. I lead the Republicans, Senator SETZLER leads the Democrats. The PRESIDENT Pro Tempore, he's the leader of the Senate. The Senate buck stops at the desk of the Pro Tempore. Senator LEATHERMAN is the Pro Tempore of the Senate. It's an awesome job. It's a part-time job that requires full-time attention. In addition to being the PRESIDENT Pro Tempore, Senator LEATHERMAN is the Chairman of the Finance Committee. It's also an awesome job, a part-time job that requires full-time attention. The Chairman of the Finance, our PRESIDENT Pro Tempore is also the Chairman of the Senate Operations and Management Committee, Chairman of the Executive Salary and Performance Committee and also Chairman of the Joint Bond Review Committee. He is a member, of what until this morning, was called the Budget and Control Board. He is the only Senator that sits on the State Infrastructure Bank and he also serves on four additional standing committees -- the Chairman of Finance, the PRESIDENT Pro Tempore. You may ask me if I think the PRESIDENT Pro Tempore is capable of being the Chairman of Finance. He absolutely is capable, more than capable of being the Chairman of Finance. Then you may ask me, are you saying the PRESIDENT Pro Tempore, Senator LEATHERMAN, is capable of being a good PRESIDENT Pro Tempore? The answer for that is absolutely he is. He's capable of being Chairman of Finance, he's capable of being PRESIDENT Pro Tempore -- just not at the same time. Few people could and still fewer people would want to. My 5th great-granddaddy back was Colonel Fredrick Hambright. His sword is on display and his blood is in the ground of a mountain ironically called Kings Mountain. During the battle of Kings Mountain, he led patriots during the Revolutionary War that were opposed to a monarchy.
Senator LEATHERMAN, being PRESIDENT Pro Tempore and Finance Committee Chairman is too much and this session is proof of that. I'm not asking this as Majority Leader. I'm not asking this as your desk mate of 35 years. I'm not asking this as a direct descendent of Colonel Fredrick Hambright. I'm asking this out of concern for you. I'm asking this out of concern for the Senate. I'm asking this out of concern for this State. It is with my utmost respect that I ask you to relinquish your position as the Senate PRESIDENT Pro Tempore today.
Senator JACKSON rose for an Expression of Personal Interest.
Thank you Mr. PRESIDENT and members of the Senate. Senator PEELER motivated me to do what I wanted to do at the end of the session, particularly when I hear that the Senate refused to debate the Roads Bill, and I want to call your attention to something that is dated April 28th. We had the opportunity to debate the Roads Bill and I just want to say this for the record, you all know, I don't get up here often and the longer I am here the less I get up because I have learned familiarity often breeds contempt. I really want say what's in my heart, and the truth of the matter is there was a vote on the Roads Bill that came out of Finance to be put on Special Order so roads could be debated. That does not mean you are for that version or against that version, and that vote failed -- that vote failed.
Senator PEELER, you know I love you and you are my friend; I call you quarterback. What is so disappointing to me is that was in April. We had time in the session to debate that Bill. The question was should we debate the Roads Bill putting it on Special Order, and as we all know doesn't mean that we are for one version or the other. It says let us put it in priority order so that we can have a debate on the Roads Bill, and Senator GROOMS, my good friend, he and I got into a little discussion about semantics and I apologized to him on that because I did not mean it to be personal, but it is ironic to me now that we are approaching July and we are talking about how dysfunctional the Senate is because we cannot get to a vote on the Roads Bill.
Now pull the roll call and you'll see the Senators who voted no. Do not paint all of us with the same brush when you talk about the Roads Bill. I'm not here to talk about ethics, I'm not here to talk about an income tax cut. I am here to talk about the Roads Bill because when my constituents stop me they do not ask me about ethics and an income tax cut. They want to know what happened to the Roads Bill. The truth of the matter is many of us, many of you, let me be honest, did not even want to debate the Roads Bill when we had time in this body to have a healthy and a consistent debate. We moved to change the order of the day to have a debate on the Roads Bill that would last one day about twelve days before the session ended. So when you want to talk, and I am not trying to be partisan, but the facts are the facts, when you want to talk about who did not vote to have a debate on the Roads Bill note how many democrats voted no. I think members of the media should take note of that -- when you are reporting on what happened in this "dysfunctional body" that is called the Senate. Go back to that original vote that was on Special Order. Senator LEATHERMAN got it out of the committee and we had a chance to debate it. We could have amended it, Senator DAVIS could have amended it however he wanted to, but you guys did not even want to vote. So when you call this body dysfunctional, clarify that. When it comes to the roads, personally I get offended when you paint me with the same brush that you paint others who refuse to even bring this up for a vote. Thank you.

I want to follow up on Senator JACKSON's comments. I am fearful about where the Senate is heading and I hope we will all step back and take a breath.
Senator JACKSON made a point as it relates to the Senate and the vote earlier this year, to put the Roads Bill on Special Order. There was a motion to set this legislation for Special Order; however, that vote failed. Subsequently, we do not control the motion period for further motions. In fact, I tease our Presiding Officer about having a crick in his neck such that he only looks to one side of the Senate Chamber. That is a joke with him, and he knows that. Factually, we do not control the motion period. Also, Senator CLEARY says that the House of Representatives touts that they have done their job. He is correct in that they did their job late; thereby, the House of Representatives sent their version of the Bill to the Senate late in session.
This session, we, first, could not get the votes necessary to set the Roads Bill for Special Order. We then had a three week debate on the 20 week Bill which had been put on Special Order before roads after which we had a three week filibuster on the Capitol Reserve Bill.
We came here in January ready to debate roads, and we are still ready to debate roads. We can stay here this summer and debate roads. If you want to deal with a Sine Die and Continuing Resolution, we can do that. We now need to do the jobs we were elected to do, and stay here and deal with roads.
When you address the roads issue, you should not bring income tax relief and restructuring of the Department of Transportation into the discussion. Income tax relief has zero to do with fixing the roads of South Carolina, as they are two separate issues. There was not a major effort to reform the Department of Transportation until we started talking about fixing roads. We need to act in a bipartisan effort like we just did with the Continuing Resolution. We need to deal with the roads issue, straight up -- up or down. If we need to deal with restructuring the Department of Transportation, we should deal with it. I voted to not sunset the Department of Transportation, and I support the Governor making that appointment. But, we need to do that in a separate Bill and do it in a bipartisan way. If you are for income tax relief, whether you want tax relief for the upper class, middle class or lower class, we need to discuss that separately.
We should not bind these three items together and play games with the public by saying we cannot get a Bill to address our roads because we cannot get income tax relief, and we cannot get roads fixed because we cannot get transportation restructuring. The public is smarter than that. They want our roads fixed.
Next, there is talk about not passing the Ethics Bill. Let me tell you why Ethics Legislation died. This is what nobody will say. Ethics died because it got amended such that out of state money influencing elections in South Carolina was going to have to be reported. Once that amendment was adopted, that train stopped.
If you want to deal with roads, let's deal with roads.

SECTION 2. (A) Of the funds appropriated above in Section 1, item (2) to the Commission on Higher Education for Out of State Veteran Tuition Reimbursement-Colleges, the Office of State Treasurer is directed to establish a fund, separate and distinct from the general fund and all other funds, entitled the College and University Out of State Veteran Tuition Differential Reimbursement Fund. Any funds appropriated in this act for this purpose must be deposited into the fund and interest accrued by the fund must remain in the fund.
(B) The purpose of the fund is to reimburse public institutions of higher learning, as defined in Section 59-103-5 of the 1976 Code, for revenue loss resulting from the provisions of Section 59-112-50(C). By March 1, 2016, a public institution of higher learning seeking a reimbursement from this fund must submit an application to the Commission on Higher Education to receive a reimbursement from the fund. The total reimbursement to a public institution may not exceed the difference between the amount the institution would have charged but for Section 59-112-50(C), and the amount the institution actually charged. The Commission on Higher Education may require any proof it determines necessary to verify the veracity of the application.
(C) By June 15, 2016, the Commission on Higher Education must distribute the funds to those institutions that have applied pursuant to subsection (B). In the event that the total requested and verified reimbursements exceed the amount in the fund, the distribution to each public institution shall be reduced pro rata based on the institution's amount of verified reimbursements compared to the total amount of verified reimbursements of all institutions.
SECTION 3. Funds appropriated above in Section 1, item (14) to the Department of Transportation shall be used to fund the Orangeburg District Office Building Renovation, Clarendon County Maintenance Complex Construction, SHEP Greenville/Spartanburg Office Construction, and Lexington Maintenance Complex Construction.
SECTION 4. The Comptroller General shall post the appropriations contained in SECTION 1 of this joint resolution as provided in Section 11-11-320(D) of the 1976 Code. Unexpended funds appropriated pursuant to SECTION 1 of this joint resolution may be carried forward to succeeding fiscal years and expended for the same purposes.
SECTION 5. This joint resolution takes effect thirty days after the completion of the 2014-2015 Fiscal Year in accordance with the provisions of Section 36(B)(3)(a), Article III, Constitution of South Carolina, 1895, and Section 11-11-320(D)(1) of the 1976 Code. /

Mr. PRESIDENT, the Resolution that is being read across the desk is a new Sine Die Resolution. I'd ask that you give me your attention for a second, Senators. We have talked a lot today about the Roads Bill and about our inability to get to a Roads Bill. There has been a lot of discussion about what happened, Senator SETZLER, and why we couldn't get to a Roads Bill. So my Resolution to Sine Die, just a new Sine Die -- it keeps everything we have in the existing Sine Die. But it makes one exception, it adds H. 3579, the House Roads Bill, to Sine Die. So if we agree to this, in a second I am going to ask unanimous consent that this Resolution be given immediate consideration and be placed on the Calendar. So if we agree to this, then that means we can take up the Roads Bill this afternoon, tomorrow, Thursday, next week, at the call of the chair. Like we have done on the budget, it puts a little more pressure on both sides to get together. Now I disagree on one thing that was said earlier today -- that the Senate would come together on a Roads Bill. I have been in this General Assembly seventeen years and I've never seen us finish the way we started which is 10 miles apart. Now I am convinced, the only way we are ever going to get a Roads Bill out of this Senate, because right now, Mr. Majority Leader, you are right, the Roads Bill is stuck in the Senate. I am convinced the only way we are ever going to get a Roads Bill out and back for the people of South Carolina, Senator McELVEEN, is to start taking some votes. That has been, Senator HAYES, I read his comments, that has been our biggest frustration; that we have not been able to start taking some votes on a Roads Bill. So I know that there are some people that I might be taking by surprise. I am not trying to catch anyone by surprise. Senator CLEARY has led a committee for two and one-half years and I stand here today and will tell you that the Senate has seen better days for our failure to pass a Roads Bill. I think that we need to do that. I think if we have to stay here every hour that we are in session for the next couple of weeks, I am one Senator that is prepared to do so and I hope you will too. Because you know and I know that some of us will be less comfortable next year voting for certain provisions of a Roads Bill than this year.
So my point is this, I have heard a lot of discussion about what the Governor may or may not support in a roads package. I have heard a lot discussions about what one Senator may or may not support on DOT reform. I have heard a lot of conversation about how much we've got to get in tax relief. Well my frustration, my greatest frustration, is that we have failed to take a single vote on a single amendment on a Roads Bill. I have heard a lot about abortion the last five weeks. I have heard a lot about the Capital Reserve Bill in the last five weeks and a lot about C Funds, and if anyone thinks that we can pat ourselves on the back by spending $300-400 million this year on roads and we can go home and tell our constituents that we fixed the roads problem, then we are kidding ourselves. We are absolutely kidding ourselves. So I am going to give you one last chance in a minute, I am going ask unanimous consent and I am going to give you one last chance to put the Roads Bill back on the Calendar and let's see if we can start taking some votes. And if we need to stay here all night, I'll order dinner.
