VERSIONS OF THIS BILL
TO AMEND ACT 748 OF 1978, AS AMENDED, RELATING TO THE DARLINGTON COUNTY SCHOOL DISTRICT AND THE BOARD OF EDUCATION OF DARLINGTON COUNTY, SO AS TO PROVIDE THAT THE DARLINGTON COUNTY SCHOOL DISTRICT SHALL OFFER EMPLOYEES WHO WORK LESS THAN TWELVE MONTHS ANNUALLY THE OPTION OF BEING PAID OVER THE LENGTH OF THEIR CONTRACT INSTEAD OF ON A YEAR-ROUND BASIS, TO PROVIDE THIS OPTION MUST BE MADE ANNUALLY, AND TO PROVIDE EMPLOYEES ONLY MAY CHANGE AN ELECTION IN AN ANNUAL CONTRACT.
Be it enacted by the General Assembly of the State of South Carolina:
SECTION 1. Act 748 of 1978, as last amended by Act 416 of 2006, is amended by adding by an appropriately numbered Section to read:
"Section __. (A) The Darlington County School District may pay annual wages to an employee on a year-round basis, but if the employee has a work schedule of less than twelve months the district shall offer the employee the option of being paid over the length of his contract. The district shall offer this option to an employee in each annual employment contract. An employee only may change his election each year in his annual contract.
(B) The provisions of this section apply notwithstanding another provision of law or contract."
SECTION 2. This act takes effect upon approval by the Governor.
