To whom was referred a Bill (H. 4143) to amend Section 56-5-4710, Code of Laws of South Carolina, 1976, relating to the use of mounted oscillating, rotating, or flashing red lights by 3, etc., respectfully

REPORT:

That they have duly and carefully considered the same and recommend that the same do pass with amendment:

Amend the bill, as and if amended, by striking all after the enacting words and inserting:

/SECTION    1.    Section 56-5-4710 of the 1976 Code is amended to read:

"Section 56-5-4710.    Wreckers may must use a mounted oscillating, rotating, or flashing red light only at the scene of accidents an emergency scene and at any time while rendering assistance on the roadside."

SECTION    2.    This act takes effect upon approval by the Governor.            /

Renumber sections to conform.

Amend title to conform.

STATEMENT OF ESTIMATED FISCAL IMPACT

Explanation of Fiscal Impact

State Expenditure

Currently, the driver of a tow truck or wrecker may use a mounted, oscillating, rotating, or flashing red light only at the scene of an accident. This bill clarifies that the driver of the tow truck or wrecker must use only non-red flashing warning lights when he is towing a vehicle and there is no accident involved.

Department of Public Safety. While the Department of Public Safety screens tow trucks on the wrecker rotation list, this bill only relates to the timing of the use of flashing red lights and would not impact that screening process. We anticipate this bill will have no expenditure impact on the general fund, other funds, or federal funds, as it does not materially or fiscally impact state agencies.

TO AMEND SECTION 56-5-4710, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO THE USE OF MOUNTED OSCILLATING, ROTATING, OR FLASHING RED LIGHTS BY WRECKERS, SO AS TO PROVIDE WRECKERS MUST USE THEIR NONRED FLASHING WARNING LIGHTS WHEN PICKING UP ANOTHER VEHICLE.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION    1.    Section 56-5-4710 of the 1976 Code is amended to read:

"Section 56-5-4710.    (A)    Wreckers may use a mounted oscillating, rotating, or flashing red light only at the scene of accidents.

(B)    Wreckers must use their nonred flashing warning lights when picking up another vehicle."

SECTION    2.    This act takes effect upon approval by the Governor.
