TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 44-29-45 SO AS TO REQUIRE VACCINE ADMINISTRATORS TO OBTAIN WRITTEN INFORMED CONSENT BEFORE ADMINISTERING A COVID-19 VACCINATION TO A PERSON; AND TO CREATE CRIMINAL PENALTIES.
Be it enacted by the General Assembly of the State of South Carolina:
SECTION 1. Chapter 29, Title 44 of the 1976 Code is amended by adding:
"Section 44-29-45. (A) Any COVID-19 vaccination administrator in the State of South Carolina must obtain written informed consent before administering a COVID-19 vaccination to a person. The department shall develop a template to be used statewide by COVID-19 vaccination administrators when obtaining written informed consent that lists all potential side effects and contraindications of a COVID-19 vaccination.
(B) A vaccine administrator who violates subsection (A) is guilty of a misdemeanor and, upon conviction, may be fined not more than twenty-five thousand dollars or imprisoned not more than one year, or both."
SECTION 2. This act takes effect upon approval by the Governor.
