State Expenditure
This bill extends the sunset provision in Section 2 of Act 205 of 2016, as last amended by Act 144 of 2022, from June 30, 2024, to June 30, 2026. Act 205 of 2016 relates to the eminent domain of property to exclude private, for-profit pipeline companies from the definition of public utility.
PSC indicates that the extension of the sunset from June 30, 2024, to June 30, 2026, to exclude private, for-profit companies from the definition of public utility will not increase the workload of the agency or require the agency to retain outside experts. Therefore, the bill will have no expenditure impact on PSC.

TO AMEND SECTION 2 OF ACT 205 OF 2016, AS AMENDED, RELATING TO THE EXEMPTION OF PRIVATE, FOR-PROFIT PIPELINE COMPANIES FROM CERTAIN RIGHTS, POWERS, AND PRIVILEGES OF TELEGRAPH AND TELEPHONE COMPANIES THAT OTHERWISE ARE EXTENDED TO PIPELINE COMPANIES, SO AS TO EXTEND THE SUNSET PROVISION TO JUNE 30, 2026.
Be it enacted by the General Assembly of the State of South Carolina:
SECTION 1. SECTION 2 of Act 205 of 2016, as last amended by Act 144 of 2022, is further amended to read:
SECTION 2. Unless the General Assembly amends Section 58-7-10 in any manner before the passing of three years after the effective date of this act or if the language of subsection (B) is reenacted or otherwise extended by the General Assembly, the provisions of subsection (B), as added by this act, are repealed June 30, 20242026.
SECTION 2. This act takes effect upon approval by the Governor.
