AN ACT TO AMEND SECTION 1-7-80, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO THE APPROPRIATIONS TO THE ATTORNEY GENERAL FOR EXPENSES OF LITIGATION, SO AS TO DELETE THE REQUIREMENT THAT THE ATTORNEY GENERAL PROVIDE BLANK INDICTMENTS FOR THE CIRCUIT SOLICITORS, AND TO AMEND SECTION 1-7-940, RELATING TO THE DUTIES OF THE SOUTH CAROLINA COMMISSION ON PROSECUTION COORDINATION, SO AS TO ADD THE DUTY OF PROVIDING BLANK INDICTMENTS FOR THE CIRCUIT SOLICITORS.
Be it enacted by the General Assembly of the State of South Carolina:
Requirement to provide blank indictments deleted
SECTION 1. Section 1-7-80 of the 1976 Code is amended to read:
"Section 1-7-80. The annual appropriation for the Attorney General for the expenses of litigation is subject to the following conditions:
(1) the Attorney General shall conduct all litigation which may be necessary for any department of the state government or any of the boards connected therewith, and all these boards or departments are forbidden to employ any counsel for any purpose except through the Attorney General and upon his advice;
(2) out of this appropriation the Attorney General shall pay for dockets for the several circuit solicitors and those other expenses as he may deem advisable."
Requirement to provide blank indictments added
SECTION 2. Section 1-7-940(A) of the 1976 Code is amended by adding a new item (4) to read:
"(4) provide blank indictments for the circuit solicitors."
Time effective
SECTION 3. This act takes effect upon approval by the Governor.
