AN ACT TO CREATE THE FAIRFIELD COUNTY ECONOMIC DEVELOPMENT BOARD; TO PROVIDE FOR ITS MEMBERS AND TERMS, ITS PURPOSE, POWERS, AND DUTIES.
Be it enacted by the General Assembly of the State of South Carolina:
Development Board created, members, terms
SECTION 1. (A) There is created a commission in and for Fairfield County to be known as the Fairfield County Economic Development Board composed of:
(1) the following ex officio members:
(a) the resident Fairfield County legislative delegation;
(b) one member of the Winnsboro City Council or the Mayor of Winnsboro, either of whom must be designated by the city council;
(c) the chairman of the Fairfield County Council;
(d) one member of the Fairfield County Council other than the chairman, to be designated by the county council;
(e) one member of the Ridgeway Town Council or the Mayor of Ridgeway, either of whom must be designated by the town council;
(f) one member of the Fairfield County School Board to be designated by the board;
(2) the following members who shall serve a term of four years and until their successors are appointed and qualify:
(a) one member of the Fairfield County Chamber of Commerce to be appointed by the ex officio members of the board in item (1) upon the recommendation of the chamber;
(b) one member of the Winnsboro Downtown Development Association to be appointed by the ex officio members of the board in item (1) upon the recommendation of the association;
(c) six members from the county at large to be elected by the ex officio members in item (1) and the members in subitems (a) and (b) of this item by a majority vote;
(3) the following nonvoting members:
(a) the Winnsboro Town Manager;
(b) the Fairfield County Administrator;
(c) the Fairfield County school superintendent who shall serve ex officio.
(B) Those members serving four-year terms may be reappointed to the board, and a vacancy must be filled in the manner of the original appointment for the unexpired portion of the term. All appointments to the board must be transmitted to the clerk of court for Fairfield County who shall properly record the appointments in the permanent records in the clerk's office.
Purpose
SECTION 2. The board is created for the purpose of aiding Fairfield County in the promotion of the industrial and commercial expansion and development in the county.
Meetings and proceedings
SECTION 3. The board shall elect one of its members as chairman and one as secretary-treasurer. Meetings of the board must be held at the call of the chairman and at other times as the board determines. The members of the board shall serve without pay but may be reimbursed for actual expenses incurred in attending meetings and other necessary expenses incurred in connection with business of the board. The board shall keep minutes of its proceedings and shall make records of all official actions. These minutes and records must be available for inspection at all times by the Fairfield County legislative delegation, the Fairfield County Council, the Winnsboro City Council, and the Town of Ridgeway.
Powers
SECTION 4. The board, in carrying out the purposes of this act, has power to employ personnel, enter into contracts, and other necessary powers incident to the purposes of this act.
Budget and funding
SECTION 5. To pay for industrial surveys, geological surveys, and other necessary expenses of the board, a sum may be appropriated in the annual Fairfield County budget, the annual budget of the City of Winnsboro, and the annual budget of the Town of Ridgeway. The board may draw the proceeds of these appropriations and future authorizations to be expended under the provisions of this act. A semiannual itemized verified statement of all expenditures signed by the chairman and secretary-treasurer must be filed with the Winnsboro City Council, the Fairfield County legislative delegation, the Fairfield County Council, and the Town of Ridgeway. The board may accept gifts and grants of money from either private or public sources to be used in the promotion of the purposes of this act, and all such monies must be accounted for in the same manner as funds appropriated by Fairfield County, the City of Winnsboro, and the Town of Ridgeway.
Audits
SECTION 6. The books and records of the board must be audited annually by the same person or firm who audits the books and records of Fairfield County. Copies of this audit must be made available to the Fairfield County legislative delegation, the Fairfield County Council, the Winnsboro City Council, and the Town of Ridgeway.
Cooperation with other entities
SECTION 7. For the purpose of carrying out the provisions of this act, the board is authorized to cooperate with the South Carolina State Development Board, all towns, chambers of commerce, business leagues, civic clubs, and other similar organizations in Fairfield County, and all other agencies and organizations within and without the county that the board may desire to cooperate with in the furtherance of the development and advertisement of Fairfield County.
Time effective
SECTION 8. This act takes effect upon approval by the Governor.
