To whom was referred a Joint Resolution (H. 4617), to approve regulations of the South Carolina Law Enforcement Training Council, relating to certification and recertification, etc., respectfully

REPORT:

That they have duly and carefully considered the same, and recommend that the same do pass:

A JOINT RESOLUTION

TO APPROVE REGULATIONS OF THE SOUTH CAROLINA LAW ENFORCEMENT TRAINING COUNCIL, RELATING TO CERTIFICATION AND RECERTIFICATION, DESIGNATED AS REGULATION DOCUMENT NUMBER 1404, PURSUANT TO THE PROVISIONS OF ARTICLE 1, CHAPTER 23, TITLE 1 OF THE 1976 CODE.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION 1. The regulations of the South Carolina Law Enforcement Training Council, relating to certification and recertification, designated as Regulation Document Number 1404, and submitted to the General Assembly pursuant to the provisions of Article 1, Chapter 23, Title 1 of the 1976 Code, are approved.

SECTION 2. This joint resolution takes effect upon approval by the Governor.

SUMMARY AS SUBMITTED BY PROMULGATING AGENCY.

38-120 limits certification to a single class reflecting current employment.

38-130 creates a new class combining Class 1-LE and Class 2-LCO for those law enforcement officers who have regular duties as well as jail responsibilities.

38-140 allows an officer to move from one class to another without additional training provided the officer was initially trained in the new class and has no break in service.

38-210 sets the in-service requirements for the new class of law enforcement officers.

38-230 provides for an extension of time to complete in-service training requirements due to military leave and medical, disability and/or administrative leave.
