AN ACT TO AMEND SECTION 2-1-25, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO ELECTION DISTRICTS FROM WHICH MEMBERS OF THE HOUSE OF REPRESENTATIVES ARE ELECTED BEGINNING IN 1994, SO AS TO REVISE CERTAIN OF THESE DISTRICTS; TO AMEND SECTION 2-1-65, RELATING TO ELECTION DISTRICTS FROM WHICH MEMBERS OF THE SENATE ARE ELECTED BEGINNING IN 1996, SO AS TO REVISE CERTAIN OF THESE DISTRICTS, TO PROVIDE THAT A MEMBER OF THE HOUSE OR A MEMBER OF THE SENATE AS APPROPRIATE SHALL BE ELECTED FROM EACH OF THESE ELECTION DISTRICTS SO REVISED AT A SPECIAL ELECTION TO BE CONDUCTED IN NOVEMBER, 1997, TO PROVIDE FOR THE TERM OF OFFICES OF SUCH MEMBERS ELECTED IN 1997, TO ESTABLISH FILING AND ELECTION DATES AND ELECTION PROCEDURES FOR THESE ELECTIONS, TO DESIGNATE THE HOUSE OF REPRESENTATIVES AND THE PRESIDENT PRO TEMPORE OF THE SENATE AS THE SUBMITTING AUTHORITY FOR THEIR RESPECTIVE BODY TO MAKE THE REQUIRED SUBMISSION OF THE ELECTION DISTRICT REVISIONS CONTAINED IN THIS ACT TO THE UNITED STATES DEPARTMENT OF JUSTICE UNDER THE VOTING RIGHTS ACT; AND TO REPEAL SECTION 2-1-15 RELATING TO ELECTION DISTRICTS FROM WHICH MEMBERS OF THE HOUSE OF REPRESENTATIVES WERE FORMERLY ELECTED.

SECTION 2. Section 2-1-15 of the 1976 Code is repealed.
Special election date; terms
SECTION 3. A member of the House of Representatives shall be elected from each of the election districts revised by provisions of Section 2-1-25 of the 1976 Code, as amended by Section 1 of this act, in a special election to be conducted on the first Tuesday after the first Monday in November of 1997. The members so elected shall serve for terms of one year to expire on the Monday following the 1998 general election. Until the revisions to such districts take effect, the districts now provided by law or court decision, as applicable, continue to apply for purposes of vacancies in office for members of the House of Representatives.

Special election date; terms
SECTION 5. Notwithstanding the requirements of Section 2-1-65, as amended by Act 49 of 1995, that the election districts take effect beginning with the 1996 general election, a member of the Senate shall be elected from each of the election districts revised by Section 4 of this act in a special election to be conducted on the first Tuesday after the first Monday in November of 1997. The members so elected shall serve for terms of three years to expire on the Monday following the 2000 general election. Until the revisions to these districts take effect, the districts now provided by law or court decision, as applicable, continue to apply for purposes of vacancies in office for members of the Senate.
Filing; primary election date; election procedures
SECTION 6. For purposes of the 1997 election for the members of the House of Representatives to be elected from those election districts revised by the provisions of Section 2-1-25 of the 1976 Code, as amended by Section 1 of this act, and for the members of the Senate to be elected from those election districts revised by Section 4 of this act, the following provisions apply:
(1) Notwithstanding the provisions of Section 7-11-15 of the 1976 Code, the dates for filing for all candidates seeking nomination by a political party primary or political party convention are between noon on June second and noon on June sixteenth.
(2) Notwithstanding the provisions of Section 7-11-210 of the 1976 Code, the date for filing the notice of candidacy and pledge is by noon on June sixteenth.
(3) Notwithstanding the provisions of Section 7-13-40 of the 1976 Code, certification of the names of all candidates to be placed on primary ballots must be made by the political party chairman, vice chairman, or secretary to the State Election Commission or the county election commission, whichever is responsible under law for preparing the ballot, not later than noon on June eighteenth.
(4) Notwithstanding the provisions of Section 7-13-40 of the 1976 Code, the date for primary elections is the second Tuesday in August.
(5) For these elections held in 1997 only, if run-off primary elections are necessary they must be held on August twenty-sixth.
(6) Notwithstanding the provisions of Section 7-13-351 of the 1976 Code, all candidates seeking nomination by petition must file these petitions with the State Election Commission no later than noon on September ninth.
(7) Notwithstanding the provisions of Section 7-13-350 of the 1976 Code, the names of all nominees to be placed on the special election ballots must be certified by the respective political party to the appropriate election commissioners by noon on September eleventh.
Senate Voting Rights Act submissions
SECTION 7. Upon the effective date of this act, the President Pro Tempore of the South Carolina Senate is designated as the appropriate official of the submitting authority who is responsible for making submissions of the revised election districts set forth in Section 4 of this act to the Chief, Voting Section, Civil Rights Division, Department of Justice, in compliance with Section 5 of the Voting Rights Act of 1965, as amended, and Title 28, Part 51 of the Code of Federal Regulations.
House Voting Rights Act submissions
SECTION 8. Upon approval of this act by the Governor and pursuant to 28 CFR Section 51.23, the House of Representatives is designated the submitting authority to make the required submission to the United States Department of Justice under Section 5 of the Voting Rights Act, as amended, 42 U.S.C. 1973a, of the House election district revisions set forth in this act.
Time effective
SECTION 9. This act takes effect upon approval by the Governor.
