TO APPROVE REGULATIONS OF THE DEPARTMENT OF PUBLIC SAFETY, RELATING TO THE DIVISION OF MOTOR VEHICLES, ADMINISTRATION AND ENFORCEMENT OF THE FINANCIAL RESPONSIBILITY ACT AND LAWS REGARDING MOTOR VEHICLE REGISTRATION AND FINANCIAL SECURITY, DESIGNATED AS REGULATION DOCUMENT NUMBER 2182, PURSUANT TO THE PROVISIONS OF ARTICLE 1, CHAPTER 23, TITLE 1 OF THE 1976 CODE.
Be it enacted by the General Assembly of the State of South Carolina:
SECTION 1. The regulations of the Department of Public Safety, relating to the Division of Motor Vehicles, administration and enforcement of the Financial Responsibility Act and laws regarding motor vehicle registration and financial security, designated as Regulation Document Number 2182, and submitted to the General Assembly pursuant to the provisions of Article 1, Chapter 23, Title 1 of the 1976 Code, are approved.
SECTION 2. This joint resolution takes effect upon approval by the Governor.
SUMMARY AS SUBMITTED BY PROMULGATING AGENCY.
To satisfy the requirements of Section 23-6-30 of the 1976 Code, the department is repealing existing regulations involving the Administration and Enforcement of the South Carolina Automobile and Reparation Act currently found in Regulations 63-441 through 63-455 of the old Department of Highways and Public Transportation regulations and replacing a portion of these regulations with certain revisions in a chapter designated for the South Carolina Department of Public Safety. Regulations 63-443, 63-447 through 63-455 are no longer necessary because the statutes governing these regulations are clear. The remaining regulations need to be placed in a chapter under the Department of Public Safety with changes to reflect the Department of Public Safety. Regulation 63-441 needs to be revised due to 1994 and 1996 amendments to the 1976 Code Section 56-10-10. Regulation 63-446 needs to be revised to provide procedures for political subdivisions to follow if they wish to be self-insured with the department.
