TO APPROVE REGULATIONS OF THE BOARD OF EDUCATION, RELATING TO USE AND DISSEMINATION OF TEST RESULTS, DESIGNATED AS REGULATION DOCUMENT NUMBER 2368, PURSUANT TO THE PROVISIONS OF ARTICLE 1, CHAPTER 23, TITLE 1 OF THE 1976 CODE.
Be it enacted by the General Assembly of the State of South Carolina:
SECTION 1. The regulations of the Board of Education, relating to use and dissemination of test results, designated as Regulation Document Number 2368, and submitted to the General Assembly pursuant to the provisions of Article 1, Chapter 23, Title 1 of the 1976 Code, are approved.
SECTION 2. This joint resolution takes effect upon approval by the Governor.
The State Board of Education promulgated amendments to Regulation 43-260, Use and Dissemination of Test Results. The regulation includes language for all statewide testing programs. The regulation changes language that limits the applicability of the regulation to only statewide testing programs under the South Carolina Education Finance Act and the Basic Skills Assessment Program. The regulation includes language so that the regulation complies with the South Carolina Education Accountability Act of 1998. Language that refers to the release of data by the State in accordance with the provisions of the South Carolina Freedom of Information Act and that prohibits release of data by the State prior to receipt of the data by local schools and districts is being deleted.
