Grant such a sense of purpose that we will not avoid ridicule and harassment because we speak the truth and seek to do it. Grant Your blessings on our Nation, President, State and her leaders. Bestow Your protection on our defenders of freedom. O Lord, hear our prayer. Amen.

SECTION   2.   Chapter 5, Title 45 of the 1976 Code is amended by adding:

"Section 45-5-80.   (A)   All hotels in this State that are not required by law to have a fire sprinkler system in the building shall post a notice in a conspicuous place at or near the guest registration desk no later than July 1, 2006. The posting must be on an eight and one-half inches by eleven inches sign with letters no less than three quarters of an inch in size and must state the following: 'This building meets local fire and building codes and is not required by law to have a fire sprinkler system.'

(B)   A hotel that violates the provisions of this section shall be fined up to two hundred dollars for each violation. Each day constitutes a separate violation."
SECTION   3.   This act takes effect upon approval by the Governor./

Pitts, Scarborough, Sinclair, Vaughn, Young, Altman, Vick, Barfield, Clemmons and Loftis: A JOINT RESOLUTION TO PROPOSE AN AMENDMENT TO ARTICLE I OF THE CONSTITUTION OF SOUTH CAROLINA, 1895, RELATING TO THE DECLARATION OF RIGHTS, BY ADDING SECTION 25, SO AS TO PROVIDE THAT CONSISTENT WITH THE RESPONSIBILITY OF THE STATE OF SOUTH CAROLINA, TO PROTECT, CONSERVE, AND REPLENISH THE NATURAL RESOURCES OF THIS STATE, THE PEOPLE OF SOUTH CAROLINA HAVE THE RIGHT TO HUNT, FISH, AND TAKE GAME SUBJECT TO REASONABLE RESTRICTIONS PRESCRIBED BY LAW RELATING TO METHODS, TIMES, AND LOCATIONS OF HUNTING, FISHING, AND TAKING GAME, THE RIGHTS OF THE OWNERS OF REAL PROPERTY AFFECTED BY HUNTING, FISHING, AND TAKING GAME, AND THE HEALTH AND SAFETY OF THE PEOPLE OF THE STATE.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION   1.   It is proposed that Article I of the Constitution of this State be amended by adding:

Section 25.   Hunting, trapping, and fishing and the taking of wild animals, birds, and fish are a valued part of our heritage and shall be forever preserved for the people. Fish and wildlife shall be managed by laws and regulations that provide persons with the continued opportunity to take, by traditional means and methods, species traditionally pursued by hunters, anglers, and trappers. Fish and wildlife management, including taking, shall be consistent with the state's duty to protect this heritage and its duty to conserve wild animals, birds, and fish. Hunting, fishing, or trapping by sportsmen shall always be a preferred and available means of controlling all invasive or overpopulated species. Any person who is licensed to hunt, fish, or trap and who is adversely affected by a failure to comply with this section shall have a private cause of action to enforce this section. The right of the people to hunt, fish, trap, and harvest game shall be subject only to such regulations and restrictions as the General Assembly may prescribe by general law.

SECTION   2.   The proposed amendment in Section 1 must be submitted to the qualified electors at the next general election for representatives. Ballots must be provided at the various voting precincts with the following words printed or written on the ballot:

/ "Section 39-15-1195.   (A)   The following property is subject to forfeiture upon violation of Section 39-15-1190 as described:

(1)   all property, both real and personal, in any manner knowingly used to engage in a violation or to further a violation of Section 39-15-1190;

(2)   all monies, negotiable instruments, securities, or other things of value furnished or intended to be furnished by a person to engage in or further a violation of Section 39-15-1190.

(B)   Property subject to forfeiture pursuant to this section may be seized by the department having authority upon warrant issued by a court having jurisdiction over the property. Seizure without process may be made if:

(1)   the seizure is incident to an arrest or a search pursuant to a search warrant or an inspection pursuant to an administrative inspection warrant;

(2)   the property subject to seizure has been the subject of a prior judgment in favor of the State in a criminal injunction or forfeiture proceeding based upon this section;

(3)   the department has probable cause to believe that the property is directly or indirectly dangerous to health or safety; or

(4)   the department has probable cause to believe that the property was used or is intended to be used in violation of this section.

(C)   If a seizure is made pursuant to subsection (B), proceedings pursuant to Section 44-53-530 regarding forfeiture and disposition must be instituted within a reasonable time.

(D)   Property taken or detained pursuant to this section is not subject to replevin but is considered to be in the custody of the department making the seizure, subject only to the orders of the court having jurisdiction over the forfeiture proceedings.

(E)   For the purposes of this section, when the seizure of property subject to seizure is accomplished as a result of a joint effort by more than one law enforcement agency, the law enforcement agency initiating the investigation is considered to be the agency making the seizure.

(F)   Law enforcement agencies seizing property pursuant to this section shall take reasonable steps to maintain the property. Equipment and conveyances seized must be removed to an appropriate place for storage. Monies seized must be deposited in an interest bearing account pending final disposition by the court unless the seizing agency determines the monies to be of an evidentiary nature and provides for security in another manner.

(G)   When property and monies of value as defined in this section or anything else of value is seized, the law enforcement agency making the seizure, within ten days or a reasonable period of time after the seizure, shall submit a report to the appropriate prosecution agency.

(1)   The report must provide the following information with respect to the property seized:

(a)   description;

(b)   circumstances of seizure;

(c)   present custodian and where the property is being stored or its location;

(d)   name of owner;

(e)   name of lienholder, if any;

(f)   seizing agency.

(2)   If the property is a conveyance, the report must include the:

(a)   make, model, serial number, and year of the conveyance;

(b)   person in whose name the conveyance is registered; and

(c)   name of any lienholders.

(3)   In addition to the report provided for in items (1) and (2), the law enforcement agency shall prepare for dissemination to the public upon request a report providing the following information:

(a)   a description of the quantity and nature of the property and money seized;

(b)   the seizing agency;

(c)   the make, model, and year of a conveyance; and

(d)   the law enforcement agency responsible for the property or conveyance seized.

(H)   Property or conveyances seized by a law enforcement agency or department must not be used by officers for personal purposes." /

Amend the bill, as and if amended, by striking all after the enacting words and inserting:
/SECTION   1.   Section 40-51-20 of the 1976 Code is amended to read:

"Section 40-51-20.   For the purposes of this chapter:

(1)   'Podiatry' shall mean means the diagnosis, medical and surgical, medical, or mechanical treatment limited to of all ailments of the human foot, except the administration of an anaesthetic other than local and ankle, and their related soft tissue structures to the level of the myotendinous junction. 'Podiatry' does not include the amputation of the entire foot, the administration of an anesthetic other than local, or the surgical correction of clubfoot of an infant two years of age or less.

(2)   "Diagnosis" shall mean to ascertain a disease or ailment by symptoms and findings and does not confer the right to use X-ray other than for diagnosis 'Podiatrist' means a person licensed in accordance with this chapter and by such licensure is licensed to diagnose and treat ailments of the foot and ankle.

(3) "Medical treatment" shall mean the application or prescribing of any therapeutic agent or remedy for the relief of foot ailments, except the medical treatment of any systemic disease causing manifestations in the foot.

(4) "Surgical treatment" shall mean the use of any cutting instrument to treat a disease, ailment, deformity or condition of the foot, but shall not confer the right to amputate the foot or toes."
SECTION   2.   Chapter 51, Title 40 of the 1976 Code is amended by adding:

"Section 40-51-210.   Surgery of the ankle and soft tissue structures governing the ankle must be performed in an accredited hospital or ambulatory surgery center. A podiatrist who performs these surgical procedures shall satisfy all requirements for credentials as outlined by the facility. In addition to granting or denying privileges, the governing body of each hospital or ambulatory surgery center may suspend, revoke, or modify privileges. All applicants or individuals who have privileges shall comply with all applicable medical staff bylaws, rules, and regulations, including the policies and procedures governing the qualifications of applicants and the scope and delineation of privileges."
SECTION   3.   This act takes effect upon approval by the Governor./
