The State Board of Canvassers (Board) erred in convening the hearing on short notice such that it was impossible for Protestant to serve subpoenas and get witnesses to the hearing.
The Board erred in not allowing the testimony of witnesses by affidavits given the impossibility of getting witnesses to the hearing.
The Board erred in not agreeing to hold the protest hearing in Orangeburg where it would have been more convenient to witnesses.
The Board erred in allowing the testimony of Mr. Edward Mirmow, a witness for Respondent Will McCain.
The State Board erred in not allowing the Protestant to amend his protest to include voting irregularities uncovered at the hearing.
The State Board erred in sustaining the election where it had not been conducted by the County Election Commission, but rather by its clerk acting without authority and in violation of state law.
The Board erred in sustaining an election where the ballots were improperly numbered.
The Board erred in sustaining an election where less than half of the requisite number of ballots were provided to the Nix Precinct.
The Board erred in sustaining an election where a substantial number of the voting public was denied the right to vote.
The Board erred in sustaining the election despite numerous statutory violations and violation of the state constitutional provision calling for a free right of suffrage.
The Board erred in allowing its chairman to participate in the deliberations of the reconsideration hearing held on December 8, 1986 where the chairman had not been present for the presentation of all testimony in the case, specifically he had missed all testimony presented on November 26, 1986.
The Board erred in reconsidering its prior decision of November 26, 1986.
The Board erred in that it imposed the incorrect standard of proof on the Protestant in the hearing.
The Board erred in not following the persuasive authority of In Re Election of Counsel of Village of Oak Harbor, 118 NE 2d 692 (1953).

The following schedule for the appellate procedure to be used in the House of Representatives will be followed:
1. The State Election Commission shall file the transcript, all records and exhibits no later than December 29, 1986 with the Clerk of the House of Representatives.
2. Copies of the records and exhibits shall be made available to the parties by the State Election Commission on or before December 29, 1986. The parties shall order their own copies of the transcript.
3. The Protestant must file his brief supporting his grounds for appeal with the Clerk of the House and serve it on the Respondent's attorney no later than January 9, 1987.
4. The Respondent must file his responsive brief with the Clerk of the House and serve it on the Protestant's attorney within ten days from service of the Protestant's brief.
5. The parties shall file one original and 15 copies of their brief with the Clerk of the House together with proof of service on the other parties.
6. The parties shall serve 3 copies of their brief on all opposing parties.

Appeal Before the House of
Representatives
Dear Bob:
I am today in receipt of your procedural Order of December 22, 1986 and cover letter of December 29, 1986 regarding the above-referenced appeal to the House of the election result for House District 95. The Protestant in this matter is being represented for compensation by J. Patrick Hudson, an associate in the law firm of Johnson, Toal & Battiste, P.A. My husband, William T. Toal, is a partner in this firm.
In the matter above-referenced, the House acts as a final appellate tribunal pursuant to art. III, Section 11 of the South Carolina Constitution and Section 7-17-250 of the 1976 Code of Laws of South Carolina. The House, although a legislative body, acts in this matter in an appellate judicial capacity as I see it. In this connection, our conduct as members of this tribunal would be governed by South Carolina Supreme Court Rule 33, the Code of Judicial Conduct. Canon 3C(1)(c) of this Code provides:
(1) A judge should disqualify himself in a proceeding in which his impartiality might reasonably be questioned, including but not limited to instances where:
(c) ...he knows that he, individually or as a fiduciary, or his spouse or minor child residing in his household, has a financial interest in the subject matter in controversy or is a party to the proceeding, or any other interest that could be substantially affected by the outcome of the proceeding...
Canon 3D of the Code of Judicial Conduct provides:
D. Remittal of Disqualification.
A judge disqualified by the terms of Canon 3C(1)(c) or Canon 3C(1)(d) may, instead of withdrawing from the proceeding, disclose on the record the basis of his disqualification. If, based on such disclosure, the parties and lawyers, independently of the judge's participation, all agree in writing that the judge's relationship is immaterial or that his financial interest is insubstantial, the judge is no longer disqualified, and may participate in the proceeding. The agreement, signed by all parties and lawyers, shall be incorporated in the record of the proceeding.
My husband has not participated in the trial of this matter. His law firm has and will receive hourly professional fees for the services of Mr. Hudson, which fees are not contingent upon the outcome of this appeal. I do not believe the law firm's financial interest in this matter to be substantial. I do not believe my impartiality would be in any way affected by these facts. Nevertheless, in order to avoid any potential question about this matter, I hereby disclose, and request it be placed in the record of these proceedings the basis of my disqualification to sit in the matter. In the event all parties and their lawyers should execute and place in the record a written Remittal of Disqualification, please inform me and I shall participate in the proceedings.
By copy of this letter, I am notifying counsel of record of the matters discussed herein. If you have the name of counsel for the Orangeburg Election Commission, please supply it to me.

H. 2167 -- Rep. Harvin: A CONCURRENT RESOLUTION TO CONGRATULATE JUDGE ANNELLE G. POWELL, CHIEF MAGISTRATE OF CLARENDON COUNTY, UPON BEING ELECTED PRESIDENT OF THE SOUTH CAROLINA MAGISTRATE'S ASSOCIATION.

H. 2168 -- Reps. Harvin, Blanding, McBride, Gilbert, Kirsh, White, Washington, Gordon, J. Brown, Faber, Taylor, K. Bailey, Foster, Ferguson, Williams, Rhoad, Shelton, Whipper and D. Martin: A CONCURRENT RESOLUTION TO COMMEMORATE THE ONE HUNDREDTH ANNIVERSARY OF THE DEATH OF JOSEPH HAYNE RAINEY OF GEORGETOWN WHICH WILL OCCUR AUGUST 1, 1987; TO RECOGNIZE THE FACT THAT HE WAS THE FIRST BLACK TO SIT IN THE UNITED STATES HOUSE OF REPRESENTATIVES; AND THAT THE SOUTH CAROLINA DEPARTMENT OF ARCHIVES AND HISTORY FORMULATE PLANS IN CONJUNCTION WITH THE CITIZENS OF BERMUDA FOR A SPECIAL COMMEMORATION OF THE LIFE OF THIS GREAT AMERICAN.
Whereas, August 1, 1987, will mark the one hundredth anniversary of the death of Joseph Hayne Rainey of Georgetown, the first black to sit in the United States House of Representatives; and
Whereas, at the close of the Civil War Joseph Rainey emerged into political prominence as a member of the executive committee of the newly-formed Republican Party in South Carolina; and
Whereas, in the following year he was elected as a delegate from Georgetown to the State Constitutional Convention; and
Whereas, after the convention he was elected to a seat in the State Senate which he resigned in 1870 to take a seat in the United States House of Representatives and thereby won the distinction of being the first black to be a member of that body; and
Whereas, he served in Congress until March 3, 1879. However, during his tenure he demonstrated considerable ability as the expounder of political aspirations of his race and made impressive speeches in favor of legislation to enforce the Fourteenth Amendment, the Ku Klux Act, and the Civil Rights Bill, demanding that the Negro be given all civil rights and be admitted to all public places; and
Whereas, Joseph Hayne Rainey is one of the neglected sons in the history of South Carolina and now it is incumbent upon the General Assembly to remedy this injustice by encouraging the State Department of Education to assume a leadership role in promoting the story of blacks and their contribution to the economic, political, and social development of South Carolina; and
Whereas, he lived in St. Georges, Bermuda, and was a beloved and respected member of the community there and contributed significantly to the political, social, and economic affairs of Bermuda during his stay; and
Whereas, the one hundredth anniversary of the death of Joseph Hayne Rainey is a point of reference from which schools and cities throughout the State can embark upon a study of black men and women who contributed to the evolution of liberty and freedom for all people regardless of race or religious persuasion. Now, therefore,
Be it resolved by the House of Representatives, the Senate concurring:
That the members of the General Assembly commemorate the one hundredth anniversary of the death of Joseph Hayne Rainey of Georgetown which will occur August 1, 1987, recognize that he was the first black to sit in the United States House of Representatives, and that the South Carolina Department of Archives and History formulate plans in conjunction with the citizens of Bermuda for a special commemoration of the life of this great American.
Be it further resolved that a copy of this resolution be forwarded to the State Department of Education, South Carolina Department of Archives and History, His Excellency, the Governor of Bermuda, and His Excellency, the Mayor of St. Georges, Bermuda.
