AN ACT TO AMEND ACT 440 OF 1949, AS AMENDED, RELATING TO THE ST. PAUL'S FIRE COMMISSION IN CHARLESTON COUNTY, SO AS TO PROVIDE FOR FOUR YEAR TERMS FOR ITS MEMBERS AND DESIGNATE THE AREAS FROM WHICH MEMBERS MUST BE APPOINTED, TO PROVIDE THAT THE TERMS OF CURRENT COMMISSIONERS END WHEN THEIR SUCCESSORS APPOINTED IN 1992 TAKE OFFICE, TO STAGGER THE TERMS OF COMMISSION MEMBERS, AND TO PROVIDE THAT FORMER COMMISSIONERS MAY BE APPOINTED TO THE RECONSTITUTED COMMISSION.
Be it enacted by the General Assembly of the State of South Carolina:
Board membership
SECTION 1. Section 4 of Act 440 of 1949, as last amended by Act 246 of 1979, is further amended to read:
"Section 4. The district is governed by the St. Paul's Fire Commission consisting of seven qualified electors residing in the district and areas within the district as provided in this section appointed by the Governor on the recommendation of a majority of the members of the legislative delegation of Charleston County, for terms of four years, and until their successors are appointed and qualify. Two members each must be appointed from Edisto and Hollywood and one member each must be appointed from Ravenel, Meggett, and Adams Run. They shall elect one of their number chairman and one secretary. In the event of a vacancy, the vacancy must be filled in the manner of the original appointment for the unexpired term."
Terms
SECTION 2. The members of the St. Paul's Fire Commission serving in office on the effective date of this act shall continue to serve until their successors appointed in 1992 in the manner provided by Act 440 of 1949, as amended by this act, shall take office. Seven new members of the commission must be appointed in 1992, three must be appointed for initial two-year terms to expire on June 30, 1994, and four must be appointed for initial four-year terms to expire on June 30, 1996, the initial terms of each member to be designated by the appointing authority when making the appointments, and thereafter their successors must all be appointed for four-year terms. Nothing herein prevents a current member of the commission from being reappointed to the commission in 1992 and thereafter.
Time effective
SECTION 3. This act takes effect upon approval by the Governor.
