AN ACT TO AMEND ACT 536 OF 1986, AS AMENDED, RELATING TO DORCHESTER COUNTY SCHOOL DISTRICT 4 AND OTHER SCHOOL MATTERS OF THE COUNTY, SO AS TO ESTABLISH FIVE SINGLE-MEMBER DISTRICTS FROM WHICH MEMBERS OF THE BOARD OF TRUSTEES OF DORCHESTER COUNTY SCHOOL DISTRICT 4 MUST BE ELECTED IN 1992, DELETE REFERENCES TO THE DORCHESTER COUNTY LEGISLATIVE DELEGATION APPOINTING MEMBERS OF THE BOARD, PROVIDE A PROCEDURE FOR THE FILLING OF VACANCIES ON THE BOARD, DELETE THE REQUIREMENT FOR A CANDIDATE TO FILE A STATEMENT OF CANDIDACY AND INSTEAD REQUIRE A NOMINATING PETITION; PROVIDE FOR THE TIME FOR CONDUCTING THE ELECTION; AND DELETE PROVISIONS WHICH ESTABLISHED SINGLE-MEMBER DISTRICTS FOR MEMBERS OF THE BOARD OF TRUSTEES ELECTED IN 1988.

Terms
SECTION 2. Section 2 of Act 536 of 1986 is amended to read:
"Section 2. (A) Trustees must be elected for terms of office of four years each and shall serve until their successors are elected and qualified except that of those first elected in 1992 from single-member districts, the two members receiving the fewest votes shall serve for terms of two years and until their successors are elected and qualify. At the expiration of these two-year terms, their successors must be elected for terms of four years. Trustees elected by the qualified electors of the respective single-member districts must be elected in nonpartisan elections to be conducted at the same time as the general election in 1992 and beginning in 1995 in nonpartisan elections the second Tuesday in April and every two years thereafter for the terms expiring in that year.
(B) Trustees, including executive committee members serving pursuant to Section 3 of this act, shall receive no salary, but may receive the usual mileage, subsistence, and per diem allowed by law for members of state boards, committees, and commissions."
Vacancies, statement of candidacy
SECTION 3. The first paragraph of Section 5 of Act 536 of 1986 is amended to read:
"The members of the board of trustees must be residents of the single-member district from which they are elected and must be elected as provided in this Part. Vacancies on the board must be filled at the next general election, or at a special election if the vacancy occurs more than one hundred eighty days before the next general election, at which time a successor must be elected in the same manner provided in this act for the unexpired term or for a full term as the case may be. If the vacancy occurs one hundred eighty days or less before the general election, the members of the legislative delegation representing the district shall fill the vacancy. All persons desiring to qualify as candidates and be elected to the board by the qualified electors shall file a nominating petition containing the signatures of not less than one hundred qualified electors of the district for which he offers as a candidate with the Dorchester County Election Commission at least sixty days before the date set for the election but not earlier than ninety days before the election. The commission shall examine the petition and determine its validity not later than thirty days before the election."

SECTION 4. Section 2A of Act 536 of 1968, as added by Act 268 of 1987, is deleted.
Time effective
SECTION 5. This act takes effect upon approval by the Governor.
