AN ACT TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTIONS 5-3-15 AND 55-11-185 SO AS TO PROVIDE THAT THE REAL PROPERTY OWNED BY AN AIRPORT DISTRICT COMPOSED OF MORE THAN ONE COUNTY MAY NOT BE ANNEXED BY A MUNICIPALITY WITHOUT PRIOR WRITTEN APPROVAL OF THE GOVERNING BODY OF THE DISTRICT, AND PROVIDE THAT THE REAL PROPERTY OWNED BY THE GREENVILLE-SPARTANBURG AIRPORT DISTRICT MAY NOT BE ANNEXED BY A MUNICIPALITY WITHOUT PRIOR WRITTEN APPROVAL OF THE GREENVILLE-SPARTANBURG AIRPORT COMMISSION; TO AMEND THE 1976 CODE BY ADDING SECTION 55-11-220 SO AS TO PROVIDE THAT AIRPORT DISTRICT PROPERTY IS NOT A BARRIER TO THE CONTIGUITY REQUIREMENTS FOR PURPOSES OF ANNEXATION.
Be it enacted by the General Assembly of the State of South Carolina:
Municipality may not annex certain property
SECTION 1. The 1976 Code is amended by adding:
"Section 5-3-15. No municipality may annex, under the provisions of this chapter, any real property owned by an airport district composed of more than one county without prior written approval of the governing body of the district."
Airport district property may not be annexed - conditions
SECTION 2. The 1976 Code is amended by adding:
"Section 55-11-185. No municipality may annex any real property owned by the district without prior written approval of the commission."
Property not barrier to contiguity
SECTION 3. The 1976 Code is amended by adding:
"Section 55-11-220. No such airport district property shall be a barrier to the contiguity requirements for the purposes of annexation. Any municipality or political subdivision which is contiguous to property owned by such multi-county airport district may annex, as provided by law, any property contiguous to such airport district property. Provided, that this provision shall be applicable to annexations taking place after October 1, 1994."
Time effective
SECTION 4. This act takes effect upon approval by the Governor.
