TO AMEND SECTION 25-1-350, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO THE POWERS AND DUTIES OF THE ADJUTANT GENERAL, SO AS TO ALLOW THE ADJUTANT GENERAL TO ORDER A MEMBER OF THE NATIONAL GUARD TO ACTIVE DUTY, SUBJECT TO CONSENT AND AVAILABLE FUNDING.
Amend Title To Conform
Be it enacted by the General Assembly of the State of South Carolina:
SECTION 1. Section 25-1-350 of the 1976 Code is amended by adding:
"(16) have the discretion to order to active duty a member of the National Guard or State Guard who consents to that order and for whose pay and allowances, as provided in Section 25-1-2200, funds are available to the Adjutant General without additional state appropriations. However, no member may exceed fifteen days state active duty service under this section in any federal fiscal year. Nothing in this item is to be construed as an exception to or limitation of the statutory and constitutional powers of the Governor in relation to the National Guard."
SECTION 2. This act takes effect upon approval by the Governor.
