AN ACT TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 56-5-615 SO AS TO DEFINE "FREEWAY"; TO AMEND SECTION 56-5-3170, RELATING TO PEDESTRIANS ON CONTROLLED-ACCESS HIGHWAYS, SO AS TO CHANGE CONTROLLED-ACCESS HIGHWAYS TO FREEWAYS; AND TO AMEND SECTION 56-5-3860, RELATING TO ANIMALS, BICYCLES, AND CERTAIN OTHER VEHICLES PROHIBITED ON CONTROLLED-ACCESS HIGHWAYS, SO AS TO CHANGE CONTROLLED-ACCESS HIGHWAYS TO FREEWAYS.
Be it enacted by the General Assembly of the State of South Carolina:
Freeway defined
SECTION 1. The 1976 Code is amended by adding:
"Section 56-5-615. A `freeway' is a multilane divided highway with full control of access, and grade separated interchanges, of the type comprising the National System of Interstate and Defense Highways, or other highways built essentially in conformance to the standards of them."
Pedestrians prohibited on freeways
SECTION 2. Section 56-5-3170 of the 1976 Code is amended to read:
"Section 56-5-3170. (A) No person as a pedestrian, unless otherwise directed by a law enforcement officer, shall occupy any space within the limits of the roadway and shoulder of the main facility of a freeway, except to perform public works or official duties, as a result of an emergency caused by an accident or breakdown of a motor vehicle, or to obtain assistance.
The prohibitions imposed by this subsection on the use of freeways do not apply to service roads alongside the highways.
(B) A person who violates the provisions of this section is guilty of a misdemeanor and, upon conviction, must be fined not more than one hundred dollars or imprisoned not more than thirty days."
Animals and certain vehicles prohibited on freeways
SECTION 3. Section 56-5-3860 of the 1976 Code is amended to read:
"Section 56-5-3860. (A) No person, unless otherwise directed by a law enforcement officer, shall occupy any space within the limits of the roadway and shoulders of the main facility of a freeway with an animal-drawn vehicle, a ridden or led animal, herded animals, a pushcart, a bicycle, a bicycle with motor attached, a motor-driven cycle with a motor which produces not to exceed five brake horsepower, an agricultural tractor or other farm machinery, except in the performance of public works or official duties.
The prohibitions imposed by this subsection on the use of freeways do not apply to service roads alongside the highways.
(B) A person who violates the provisions of this section is guilty of a misdemeanor and, upon conviction, must be fined not more than one hundred dollars or imprisoned not more than thirty days."
Time effective
SECTION 4. This act takes effect upon approval by the Governor.
