AN ACT TO AMEND SECTION 50-17-830, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO SEASONS, SIZE LIMITS, AND AREAS FOR TAKING ATLANTIC STURGEON, SO AS TO PROHIBIT THE POSSESSION OR SALE OF PART OF A STURGEON DURING THE CLOSED SEASON WITHOUT PROOF THAT THE PART WAS TAKEN LEGALLY.
Be it enacted by the General Assembly of the State of South Carolina:
Prohibition on possession or sale of sturgeon
SECTION 1. Section 50-17-830 of the 1976 Code is amended to read:
"Section 50-17-830. (A) The department may establish open and closed seasons, size limits, times, and areas for the taking of Atlantic sturgeon, Acipenser oxyrhynchus, in the waters of the State. A person taking, catching, having in possession, buying, or selling Atlantic sturgeon of less than or in excess of the size limits established, during the closed seasons or times, or in the closed areas established by the department is guilty of a violation of this section. A person having in possession, selling, or offering for sale part of an Atlantic sturgeon including, but not limited to, the roe or caviar, during the closed season without an invoice, bill of sale, or similar document of proof that the part was taken legally in another state or country, is guilty of a violation of this section.
(B) Sturgeon taken during the closed season or times or in the closed areas established by the division must be released immediately in the waters where caught.
(C) In addition to the penalties provided in Section 50-17-100, the catch, nets, and boats of a person accused of violating this section must be seized and, upon conviction, sold as prescribed in Section 50-17-650."
Time effective
SECTION 2. This act takes effect upon approval by the Governor.
