TO AMEND SECTION 16-15-305, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO OBSCENITY, SO AS TO INCREASE THE PENALTY TO CONFORM WITH THE CRIME CLASSIFICATION ACT OF 1993.
Be it enacted by the General Assembly of the State of South Carolina:
SECTION 1. Section 16-15-305(H) of the 1976 Code, as added by Act 168 of 1987, is amended to read:
"(H) A person who violates this section is guilty of a felony and, upon conviction, must be imprisoned for not more than three five years or fined not more than ten thousand dollars, or both."
SECTION 2. This act takes effect upon approval by the Governor and applies to offenses committed after that date.
