AN ACT TO AMEND SECTION 1-11-710, AS AMENDED, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO INSURANCE MADE AVAILABLE BY THE STATE BUDGET AND CONTROL BOARD TO ACTIVE AND RETIRED STATE AND SCHOOL DISTRICT EMPLOYEES AND OTHERS, SO AS TO PROVIDE AN EXCLUSIVE REMEDY FOR RESOLVING CLAIMS WITH RESPECT TO THE PAYMENT OF BENEFITS.
Be it enacted by the General Assembly of the State of South Carolina:
State Health Insurance claims
SECTION 1. Section 1-11-710 of the 1976 Code, as last amended by Section 19, Part II, Act 145 of 1995, is further amended by adding at the end:
"(C) Notwithstanding Sections 1-23-310 and 1-23-320 or any other provision of law, claims for benefits under any self-insured plan of insurance offered by the State to state and public school district employees and other eligible individuals must be resolved by procedures established by the board, which shall constitute the exclusive remedy for these claims, subject only to appellate judicial review consistent with the standards provided in Section 1-23-380."
Time effective
SECTION 2. This act takes effect upon approval by the Governor and applies with respect to claims for benefits pending or filed on and after that date.
