Problems facing the people of our State today are also great, as are those issues that confront so many of our sisters and brothers around the globe. So, Lord, fill the heart of each Senator and staff member in this place with Your true light, leading them to respond justly to the demands of our day. In Your loving name do we pray, dear Lord. Amen.

The Committee on Labor, Commerce and Industry proposed the following amendment (LC-171.WAB0001S), which was adopted:

Amend the bill, as and if amended, SECTION 1, by striking Section 39-75-100(6)(b) and inserting:
    (b) "Waste tire hauler" does not apply to a person hauling waste tires pursuant to a municipality's sanctioned tire clean-up event, to a county's waste tire clean-up enforcement efforts, as provided in Section 44-96-170(D), the South Carolina Department of Transportation, or to a person hauling regrooved or regroovable tires as provided in Article 1, Chapter 39 of this title.

Amend the bill further, SECTION 2, by striking Section 44-96-170(F) and inserting:
  (F) Counties may charge a tipping fee of up to one dollar and fifty cents for each waste tire manufactured in this State or up to onefour hundred fifty dollars per ton for waste tires sold or used in the county when, by local ordinance, the county prohibits the acceptance of tires with documentation. manufactured in this State for which no fee has been paid otherwise.When waste tires are accepted by a county, and proper documentation is provided, counties may charge a tipping fee of up to one hundred fifty dollars per ton for tires.

Amend the bill further, SECTION 3, by striking Section 44-96-170(N)(1) and inserting:
  (N)(1) For sales made on or after November 1, 1991, tThere is imposed a fee of two dollars for each new and used tire sold with a Department of Transportation number to the ultimate consumer, whether or not the tire is mounted by the seller. This fee is applicable to all tires included in new and used retail motor vehicles sales. The wholesaler or retailer receiving new tires from unlicensed wholesalers is responsible for paying the fee imposed by this subsection. This fee shall not be collected on farm or agricultural tires, including tires designed for use in the production of farm products as defined in Section 46-1-75(E)(1).

Senator CORBIN proposed the following amendment (SR-171.CEM0002S), which was proposed:

Amend the bill, as and if amended, SECTION 1, by striking Section 39-75-210(A)(2) and (3) and inserting:
    (2) damage exposing the reinforcing plies of the tire, including cuts, cracks, bulges, punctures, or scrapes;

(3) an improper repair that includes any repair to the tire in the tread shoulder or belt edge area, a puncture that has not been both sealed with a patch on the inside and repaired with a cured rubber stem plugging that runs to the outside, a repair to the sidewall or bead area of the tire, or a puncture repair of damage that is larger than one quarter of an inch in size;

Amend the bill further, SECTION 1, by striking Section 39-75-210(A)(6) and (7) and inserting:
    (6) inner liner or bead damage, such as a blistered liner or inner cracks; or

(7) indication of internal separation, such as bulges, carcass-to-belt or belt-to-belt separation or local areas of irregular tread wear indicating possible tread or belt separation.

Amend the bill further, SECTION 1, by striking Section 39-75-220(3) and inserting:
  (3) tires intended solely for agricultural use or for off the road industrial use.

Amend title to conform.

Amend the bill, as and if amended, SECTION 1, by striking Section 44-95-65(W) and inserting:
  (W) Each retailer, wholesaler, and distributor may be subject to unannounced compliance checks for purposes of enforcing this section. Unannounced follow-up compliance checks of all noncompliant retailers, wholesalers, and distributors are required within sixty days after any violation of this section. The results of all compliance checks and enforcement actions shall be reported to the Attorney General. The Attorney General shall make the results of all compliance checks available to the public on request.

Amend the bill, as and if amended, SECTION 1, by striking Section 44-95-65(B)(1) and (2) and inserting:
    (1) the ENDS product was on the market in the United States as of August 8, 2016, and the manufacturer has applied for a marketing order pursuant to 21 U.S.C.   (C) In the prosecution or adjudication of a person who is charged with a violation of this section, it is an affirmative defense to those charges that the person charged committed the violation under duress or was coerced into committing the violation as a result of being the victim of trafficking in persons.

(D) A person who at the time that the person violated this section was a minor at the time this section was violated may shall not be prosecuted pursuant to this section.

(E) A person who violates this section is guilty of a felony and must be imprisoned for not more than five years. misdemeanor, and upon conviction, must be punished as follows:

(1) for a first offense, a fine not exceeding two hundred dollars or confinement in prison for a period of not more than thirty days;

(2) for a second offense, a fine not exceeding one thousand dollars or confinement in prison for a period of not more than ninety days, or both; or

(3) for a third or any subsequent offense, a fine not exceeding three thousand dollars or confinement for a period of not less than one year, or both.

Amend the bill further, SECTION 1, by striking Section 16-15-100(B)(1), (2), (3), (4), (5), (6), (7), (8), (9), (10), (11), and (12) and inserting:
    (1) Procure a female inmate for a house of prostitution ;

(2) procure, recruit, sexually groom, cause, Cause, induce, persuade or encourage by promise, threat, violence, or by any scheme or device a female person to become a prostitute or to come into or leave this State or to enter, remain, or reside an inmate ofin a house ofplace, structure, building, vehicle, trailer, or conveyance for the purpose of prostitution;

(3) Induce, persuade or encourage a female to come into or leave this State for the purpose of prostitution or to become an inmate in a house of prostitution;

(4)(2) Receive recieve receive or give, or agree to receive or give, any money or thing of value for procuring or attempting to procure any female person to become a prostitute or an inmate in a house of prostitution;

(5)(3) Accept accept or receive knowingly any money or other thing of value without consideration from a prostitute; or

(6)(4) keep or set up a trailer, place, structure, or building, or any other conveyance to facilitate prostitution;

(7)(5) receive any person for purposes of prostitution into any vehicle, conveyance, trailer, place, structure, or building;

(8)(6) permit any person to remain for the purpose of prostitution in any vehicle, conveyance, trailer, place, structure, or building;

(9)(7) direct, take, or transport, offer or agree to direct, take or transport, or aid or assist in directing, taking, or transporting any person to any vehicle, conveyance, trailer, place, structure, or building or to any other person with knowledge of or having reasonable cause to believe that the purpose of such directing, taking, or transporting is prostitution;

(10)(8) lease or rent, or contract to lease or rent, any vehicle, conveyance, trailer, place, structure, or building or part thereof believing or having reasonable cause to believe that it is intended to be used for prostitution;

(11)(9) promote, market, or advertise prostitution on a media platform accessible to the public, including, but not limited to, social media platforms; or

(6)(12)(10) Aid,aid, abet or participate knowingly in the doing of any of the acts herein prohibited.

  (D) This chapter applies to concession amusement park go-karts. This chapter does not apply to super- rental karts, provided that:

(1) Only persons age eighteen or above who hold a valid driver's license are allowed to operate super-karts. An individual is allowed to operate a rental kart only if they:

(a) are eighteen years of age or older; or

(b) are fifteen years of age or older and hold a valid driver's license or permit.

(2) No person shall operate a super-rental kart in any establishment where other permanent amusement devices are located or operated. Establishments offering super-rental karts must not share an entrance or exit with any other establishment offering an a permanent amusement device and must charge a separate fee for operating super-rental karts.

(3) A sign shall be on display on the premises where super-rental karts are operated stating: "Super-Rental karts are not amusement devices regulated by the South Carolina Department of Labor, Licensing and Regulation. Super-Rental karts may reach speeds in excess of fifty forty miles per hour. Drive at your own risk."

(4) The owner of a super-rental kart must carry an insurance policy in an amount not less than one million dollars per occurrence against liability for injury to persons or property arising out of the operation or use of such device.

(5) Rental karts operated by persons under eighteen years of age must be equipped with an occupant restraint system and a rollover protection system.

Amend the bill further, SECTION 3, by striking Section 41-18-40(15)(a) and (b) and inserting:
(a) "Concession Amusement park go-kart" means an amusement ride or device that:

(i) is a single vehicle, unattached to other vehicles or a common frame system;

(ii) is powered without connection to a common energy source;

(iii) is driver-controlled with respect to acceleration, speed, braking, and steering;

(iv) operates within the containment system of a defined track;

(v) simulates competitive motor sports; and

(vi) is used by members of the general public for a fee.

(b) A concessionAn amusement park go-kart has a maximum capacity of two persons and no cargo capacity.

Amend the bill further, SECTION 3, by striking Section 41-18-40(16) and inserting:
  (16) "Super-Rental kart" means an open-wheel motorsport vehicle, with or without gearbox or shifter capability, used for racing in excess of fifty forty miles per hour. Super-Rental kart does not mean "concession amusement park go-kart" as defined by this section. Rental karts may operate, but are not limited to operating, within the containment system of a defined track.
