AN ACT TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 58-23-650 SO AS TO AUTHORIZE THE PUBLIC SERVICE COMMISSION TO ENTER INTO RECIPROCAL BASE STATE AGREEMENTS, WITH THE REGULATORY AGENCIES OF OTHER STATES HAVING JURISDICTION OVER MOTOR CARRIERS, TO PROVIDE THAT MOTOR CARRIERS REGISTERING IN THIS STATE UNDER SUCH AGREEMENTS ARE SUBJECT TO THE JURISDICTION OF THE PUBLIC SERVICE COMMISSION, TO ALLOW THE COMMISSION TO REQUIRE FILINGS OF CERTIFICATION OF INSURANCE, SURETY BONDS, AND OTHER DOCUMENTS TO SHOW A SOUTH CAROLINA BASED CARRIER'S QUALIFICATION TO OPERATE, AND PROVIDE THAT A PARTICIPATING CARRIER SHALL REGISTER ONLY WITH THE COMMISSION, AND TO AMEND SECTION 58-23-640, RELATING TO FEES AND CHARGES FOR REGISTRATION OF INTERSTATE AUTHORITY BY MOTOR CARRIERS, SO AS TO PROVIDE A FIVE DOLLAR FEE FOR AN IDENTIFIER.
Be it enacted by the General Assembly of the State of South Carolina:
Reciprocal agreements
SECTION 1. Article 5, Chapter 23, Title 58 of the 1976 Code is amended by adding:
"Section 58-23-650. The commission is authorized to enter into reciprocal agreements with the regulatory agencies of other states having jurisdiction and authority over motor carriers to provide for base state agreements in which the registration of interstate carriers operating in participating states may be accomplished by registration in one base state. Carriers registering in this State under such agreements are subject to the jurisdiction and authority of the commission. When the carrier's base state is South Carolina, the commission may require further filings of certificates of insurance, surety bonds, and other documents to show the carrier's qualifications to operate. Participating carriers shall register their authority directly with the commission and not with other state or local agencies."
Identifier fee
SECTION 2. Section 58-23-640 of the 1976 Code is amended to read:
"Section 58-23-640. The commission shall charge a fee of five dollars for each identifier. Four dollars of the five-dollar identifier fee must be remitted to the general fund and become part of the unrestricted general fund revenue. The commission may promulgate regulations pursuant to this section."
Time effective
SECTION 3. Section 1 of this act takes effect July 1, 1992. Section 2 of this act takes effect on the earlier of January 1, 1994, or the effective date of Section 4005 of the Intermodal Surface Transportation Efficiency Act of 1991, P.L. 102-240.
