Our thought for today is from Samuel 23:4: "He is like the light of morning at sunrise a cloudless morning, like the brightness after rain that brings grass from earth."

Let us pray. Blessings and honor and glory and might be with these Representatives and Staff as they continue to do their work for the people of South Carolina. Bless and keep our defenders of freedom and first responders. Look in favor on our World, Nation, President, State, Governor Speaker, Staff, and all who labor in these Halls of Government. Remember our Armed Forces and those who suffer from wounds, those seen and hidden wounds. Lord, in Your mercy, hear our prayers. Amen.

Pursuant to Rule 6.3, the House of Representatives was led in the Pledge of Allegiance to the Flag of the United States of America by the SPEAKER.

After corrections to the Journal of the proceedings of yesterday, the SPEAKER ordered it confirmed.

MOTION ADOPTED

Rep. ERICKSON moved that when the House adjourns, it adjourn in memory of her brother, Norman Monroe Smith, which was agreed to.

In Memory of Norman Monroe Smith

I would like to adjourn in memory of Norman Monroe Smith, my younger brother who passed away after a long battle with illnesses associated with addiction and dependency. I pray for all South Carolina families who suffer these illnesses and trials.

The House stood in silent prayer for the family and friends of Robert Frank "Bob" McCurry Sr.

STATEMENT FOR THE JOURNAL

This week, my business partner and dear friend of our family Matt McCurry's father, Bob McCurry of Holly Hill, widower of Caroline Rhame McCurry, passed away on Monday, April 7, 2025, at the age of 91. Bob was a giant in the SC agriculture industry. He was born in Greenwood, SC, raised in Ware Shoals, and joined the National Guard while in high school. He was a 1956 graduate of University of South Carolina. While there, he met his lifelong love, Caroline Rhame of Holly Hill, who was attending Columbia College.
After graduating, Bob was hired by the Rock Hill YMCA, eventually rising to Executive Director. When his father-in-law's health deteriorated, they moved their family to Holly Hill to help with the family farming business. Bob devoted his life from then on to agriculture, particularly farming and peach production. He served on the South Carolina Agricultural Commission and traveled to the Far East and to Europe on multiple trade missions to promote SC agriculture and commerce. He also was proud to serve for many years on the Board of Farmers and Merchants Bank.
A devoted member of Holly Hill Methodist Church, Bob taught junior high Sunday School for 33 years, sang in the choir, and served in many other roles. Bob also had a heart for teaching and coaching. He served on the board of Holly Hill Academy and was its first varsity basketball coach.
I ask that my fellow Members of the House stand for a moment of silent prayer in honor and memory of Robert "Bob" McCurry.

S. 164 (Word version) -- Senator Campsen: A BILL TO AMEND THE SOUTH CAROLINA CODE OF LAWS BY AMENDING SECTION 1-23-120, RELATING TO THE REQUIREMENTS AND PROCEDURES FOR REGULATIONS, SO AS TO TOLL THE PERIOD OF LEGISLATIVE REVIEW FROM THE SECOND FRIDAY IN MAY THROUGH THE SECOND MONDAY IN JANUARY; AND TO ADD A PROVISION REVISING THE PERIOD OF LEGISLATIVE REVIEW FOR REGULATIONS FILED ON JANUARY 14, 2025, TO ONE HUNDRED THIRTEEN DAYS.

The Committee on Regulations, Admin. Proc., AI and Cybersecurity proposed the following Amendment No. 1 to S. 164 (Word version) (LC-164.WAB0001H), which was adopted:
Amend the bill, as and if amended, SECTION 1, by striking Section 1-23-115(A) and inserting:

(A) Upon written request by two members of the General Assembly, made before submission of a promulgated regulation to the General Assembly for legislative review, a regulation that has a substantial economic impact must have an assessment report prepared pursuant to this section and in accordance with the procedures contained in this article. In addition to any other method as may be provided by the General Assembly, the legislative committee to which the promulgated regulation has been referred, by majority vote, may send a written notification to the promulgating agency informing the agency that the committee cannot approve the promulgated regulation unless an assessment report is prepared and provided to the committee. The written notification tolls the running of the one hundred-twenty-dayone-hundred-dayone-hundred-ten-day legislative review period, and the period does not begin to run again until an assessment report prepared in accordance with this article is submitted to the committee. Upon receipt of the assessment report, additional days must be added to the days remaining in the one hundred-twenty-dayone-hundred-dayone-hundred-ten-day review period, if less than twenty days, to equal twenty days. A copy of the assessment report must be provided to each member of the committee.
Amend the bill further, SECTION 2, by striking Section 1-23-120(C) and (D) and inserting:

(C) Upon receipt of the regulation, the President and Speaker shall refer the regulation for review to the standing committees of the Senate and House which are most concerned with the function of the promulgating agency. A copy of the regulation or a synopsis of the regulation must be given to each member of the committee, and Legislative Council shall notify all members of the General Assembly when regulations are submitted for review either through electronic means or by addition of this information to the website maintained by the Legislative Services Agency, or both. The committees to which regulations are referred have one hundred ten twenty days from the date regulations are submitted to the General Assembly to consider and take action on these regulations. However, if a regulation is referred to a committee and no action occurs in that committee on the regulation within sixty calendar days of receipt of the regulation, the regulation must be placed on the agenda of the full committee beginning with the next scheduled full committee meeting.

(D) If a joint resolution to approve a regulation is not enacted within one hundred ten twenty days after the regulation is submitted to the General Assembly or if a joint resolution to disapprove a regulation has not been introduced by a standing committee to which the regulation was referred for review, the regulation is effective upon publication in the State Register. Upon introduction of the first joint resolution disapproving a regulation by a standing committee to which the regulation was referred for review, the one-hundred-twenty-dayone-hundred-dayone-hundred-ten-day legislative review period for automatic approval is tolled. A regulation may not be filed under the emergency provisions of Section 1-23-130 if a joint resolution to disapprove the regulation has been introduced by a standing committee to which the regulation was referred. Upon a negative vote by either the Senate or House of Representatives on the resolution disapproving the regulation and the notification in writing of the negative vote to the Speaker of the House of Representatives and the President of the Senate by the Clerk of the house in which the negative vote occurred, the remainder of the period begins to run. If the remainder of the period is less than ninety days, additional days must be added to the remainder to equal ninety days. The introduction of a joint resolution by the committee of either house does not prevent the introduction of a joint resolution by the committee of the other house to either approve or disapprove the regulations concerned. A joint resolution approving or disapproving a regulation must include:

(1) the synopsis of the regulation as required by subsection (B)(4);

(2) the summary of the final assessment report prepared by the office pursuant to Section 1-23-115 or, as required by subsection (B)(5), the statement or explanation that an assessment report is not required or is exempt.
Amend the bill further, SECTION 3, by striking Section 1-23-120(E) and inserting:

(E) The one-hundred-twenty-dayone-hundred-dayone-hundred-ten-day legislative review period of review begins on the date the regulation is filed with the President and Speaker. Sine die adjournment of the General Assembly tolls the running of the period of review, and the remainder of the period begins to run upon the next convening of the General Assembly excluding special sessions called by the GovernorThe legislative review period is tolled from the second Friday in May through the second Monday the following January.
Amend the bill further, SECTION 4, by striking Section 1-23-120(F) and inserting:

(F) Any member of the General Assembly may introduce a joint resolution approving or disapproving a regulation thirty days following the date the regulations concerned are referred to a standing committee for review and no committee joint resolution approving or disapproving the regulations has been introduced and the regulations concerned have not been withdrawn by the promulgating agency pursuant to Section 1-23-125, but the introduction does not toll the one-hundred-twenty-dayone-hundred-dayone-hundred-ten-day legislative review period of for automatic approval.
Amend the bill further, SECTION 5, by striking Section 1-23-125(C) and inserting:

(C) The notification tolls the one-hundred-twenty-dayone-hundred-dayone-hundred-ten-day legislative review period for automatic approval, and when an agency withdraws regulations from the General Assembly prior to the time a committee resolution to approve or disapprove the regulation has been introduced, the remainder of the period begins to run only on the date the regulations are resubmitted to the General Assembly. Upon resubmission of the regulations, additional days must be added to the days remaining in the legislative review period for automatic approval, if less than twenty days, to equal twenty days, and a copy of the amended regulation must be given to each member of the committee. If an agency decides to take no action pursuant to subsection (B)(3), it shall notify the committee in writing and the remainder of the period begins to run only upon this notification.

(A) Notwithstanding the provisions of this chapter, for purposes of the South Carolina Workers' Compensation Law, any impairment or injury to the health of a firefighter caused by heart disease, stroke, or respiratory disease resulting in total or partial disability or death is presumed to have arisen out of and in the course of employment, unless the contrary is shown by competent evidence, if the firefighter is at the time of such impairment or injury a bona fide member of a municipal, county, state, port authority, or fire control district fire department in this State. In order to be entitled to the presumption provided for in this section, any person becoming a member of a fire department after May 29, 1968, must be under the age of thirty-seven years and must have successfully passed a physical examination by a competent physician upon entering into such service or by July 1, 2012, a written report of which must have been made and filed before any alleged injury with the fire department, which examination failed to reveal any evidence of such condition or conditions, and the condition or conditions developed while actively engaged in fighting a fireon duty, a technical rescue incident, or a firefighter training exercise that involves stressful or strenuous physical activity, or within twenty-four hours thereof or within twenty-four hours from the date of last service in the activity. This presumption does not apply to clerical, administrative, or sedentary activities.

The Committee on Labor, Commerce and Industry proposed the following Amendment No. 1 to H. 3129 (Word version) (LC-3129.CM0001H), which was adopted:
Amend the bill, as and if amended, SECTION 1, by striking Section 56-2-5010(A) and inserting:

(A) A business entity may operate a personal delivery device in a pedestrian area, sidewalk, or crosswalk in this State or on a highway, with the rights and duties applicable to a pedestrian, subject to the requirements and restrictions contained in this article. Except as authorized in this article, a person shall not operate a personal delivery device in a pedestrian area, sidewalk, or crosswalk, State or local road or on a highway in this State.
Amend the bill further, SECTION 1, by striking Section 56-2-5010(B)(2) and (3) and inserting:

(2) not be operated in a pedestrian area at a speed greater than ten eight miles an hour under normal operation, or a speed no greater than ten miles an hour for emergency purposes; and

(3) not be operated on a State or local roadhighway except as necessary to cross a State or local road at a designated crosswalk.highway or along a highway if a sidewalk is not provided or accessible.
Amend the bill further, SECTION 1, by striking Section 56-2-5010(D) and (E) and inserting:

(D) (C) The personal delivery device shall:

(1) obey all traffic and pedestrian-control devices and signs;

(2) yield the right of way to all human pedestrians;

(3) not unreasonably interfere with any vehicle or pedestrian; and

(4) not transport materials regulated under the federal Hazardous Materials Transportation Act.

(E) (D) A personal delivery device shall be equipped with:

(1) a marker that clearly states the name and contact information of the owner;

(2) a braking system that enables the device to come to a controlled stop; and

(3) when operated at night, lights on the front and rear that are visible and recognizable under normal atmospheric conditions from at least five hundred feet on all sides of the personal delivery device.
